my friend got the dave letter from there big gun lawyers any advice would help! they want him to admit and send back equipment and pay monitary fine

Tell your "friend" to ignore the letter. They can't prove a thing. Use it as toilet paper. Nothing to worry about. Just a scare tactic. If you, er, your "friend", gets a summons to appear at trial, ignore that too. ;)

well i hope seymour is being sarcastic
if you get a summons or court appearance i dont think ignoring it is in your best inetrest
thats if it gets that far the initial "letter" is nothing there looking for a easy buck
but if it goes to court and you/friend is a no show then the judgement would go in daves favor basically netting whatever damages dave asks for
if it gets to a court appearence consult a lawyer
start reading in this forum and go to TTRK'S legal rights page
just find one of his posts and use the link in his signature

Yes, frankiefrog, you're right on both counts. I was using sarcasm to light a fire under phuzman's derriere to get him moving. At the least he needs to contact a lawyer. Any "legal" advice phuzman gets on a forum is worth exactly what he pays for it. Ironically, when the letters first started arriving, the "advice" I stated above was exactly what nearly everyone (including a couple of prominent administrators), except me, was telling the recipients. And, there was derision of anyone who broached the subject that DirecTV might, indeed, actually follow the letters up with civil or criminal action.

ignore the letter and wait for a court summons. Most if not all never get a court summons. If they do take you to court then get a lawyer, chances are unless they get a search warrant they will not win in court. The burden of proof is on them and they will need evidence. Owning the equipment alone is not proof enought.

I think you are once again just trying to mis-inform, and twist things to suit your own purpose. By now we all know that that purpose is to try and discredit The King, And Gunsmoke. The best advise is take an hour or so and see a lawyer. The letter in itself is proof of nothing and the invoices they have also mean nothing. You can take many different routes, but as I said let a lawyer tell you what route he would recommend. Do not get all nervous about this, DTV is using a scare tatic and many people will fall for it.
As for SeymoreTV, I am starting to wonder if he is not a DTV plant. at one point I thought he maybe this Mark character that was at the Canadian Supreme Court case. This guy was a DTV lawyer from DC, and his comments have been inline with the same type of attitude this guy portrayed. Maybe he is one and the same or maybe just another hemmoroid that fell off of DTV's -------. Do not let him get you down, and he has his own agenda.

steevie, you did such a good job of accurately quoting me. Too bad you failed to comprehend what I had actually written instead of what you wanted to infer. I'll walk you through this one time - I've even re-quoted myself to make it easy for you. Take paticular note of the first six words:

Notice the part about, "first started arriving"? By time line implication, it would logically follow that there were no summons involved at that point. Ergo, the administrators, whom I did not identify in my post above, but whom you assumed to do so, yourself (and mistakenly, I might add), had yet to weigh in on how to react to summons that would not begin being issued for two or so more months. Get it? There's a good chap!

If you say these were not the Moderators you were talking about then I guess I would have to take you at your word. However, since i've been reading your NONSENSE posts for the last 6 months or so i think anyone would draw the same conclusion. Seems they are the two mods that most of your attacks are aimed at.
Actually I could care less what Seymour says about anything anymore, however, I do worry that someone who has not read any of his past posts on these subjects might do exactly what frankiefrog said and take him literally. That would truly be bad considering his does'nt have much of a grip on the situation.
Anyway i'm not getting into a pissing match with seymour....I have more important things to do like.....watch my toenails grow....
I know what it says up above seymour....explain it anyway you want....some may believe you.....I do not........

As always alot of toe dancing twisting and sliding with explainations of previous posts that are more confusing then the posts themselves ;) but for the record I always suggest to contact a lawyer..

hey phuzman do you know where your "friend" bought his stuff from? I recently bought something from a site that was shut down and was wondering if I should expect the letter as well.

Yes I have 15 posts here under this nick. To you that is inexperience and that means you are better? I should tell you how many posts I really have all totalled on this and other sites but that would be just too easy. I will say this though very few people have been in the satellite industry as long as I have. Hell your 262 posts (most of sarcasm and just inciting trouble), just makes me want to think you must be the best informed person around.
That must be why you always give so much of yourself. You seem to spend enough time here to make it a full time job. You always seem to think DTV is doing everything according to the law, and you just never seem to accept that some one may have another version. I think they call that being a tight ass. But hey everyone knows just where you stand on the issues, maybe it woould be nice if you would let them hear others views as well, without your comentery.

guess what, i don't post much, -c more-, but i read alot... and i really hang out at another forum that the "smart people" here like too!!
so let me start by saying..you have not been here all that long, but you love to crash on, (i guess everyone) but never help anyone or contribute at all, or very little.
from where i come from, you would be gone...if your not helping, your part of the problem..
this thread was started about a legal question "remeber" , you answered with a smart ass reply that really did not help the poster at ALL..
