Hi Gals & Guys,

Well unfortunately folks, we missed it. Yesterday was the "World Press Freedom Day" and its the day where we celebrate the "Freedom of the Press" in a democracy. But we have to be careful because we really need to be sure that Canada is still a democracy suitable for Celebrating. Lets see.

Well that's easy. What constitutes a democracy is really the following.

(1) Freedom of the Press (media) and freedom to read/view that which you choose. You know, where you choose to read/view the newspaper/media of your choice to keep abreast of what is happening out side your little area or country. Forbidden by Censorship of what Canadians may watch!

(2) An Independent Judiciary is crucial to a Democracy. You know where the Courts are completely free of political influence and make their own decisions totally independent of what the government thinks. Was the SCR ruling independent. NO!

(3) Respect for minorities is another democratic necessity. You know where people of other ethnic origins are free to pursue media in their own language which will usually emanate from foreign sources. If those media sources were not foreign then they likely would not be ethnic and a country could not be called multicultural based on the many people who form the country. Are ethnic Canadians able to view foreign encrypted programs. No Forbidden by censorship in the LAW!

(4) Freedom of Religion. Where people have complete freedom to practise the religion of their choice. This includes the right to receive religious broadcasts from Foreign nations who practise these minority religious freedoms and broadcast them so that people in other countries may also practise their style of worship. In Canada Forbidden by Censorship!

(5) Free and democratic elections. Having an elected parliament that upholds the law in a way that follows the wishes of the countries citizens is also one of the important signs of a modern democracy. Elected perhaps yes, citizens wishes NO!

Of these 5 major components of democracy, do any of these apply to Canada. And if they do, is there a letdown in any part of these values which constitute a democracy?

When the Supreme Court recently ruled that Canadians may not view foreign encrypted broadcasting (the majority of broadcasts using the public airwaves today) and the government of Canada is a intervenor in front of that court on behalf of Bell ExpressVu and against the citizens of the country who want foreign broadcasts, what does this say for democracy? Couple that with the fact that the Supreme Court made a very obviously political decision in their ruling, one that makes it illegal for ethnic Canadians to receive American programming in their native languages. It makes the religious programming carried on Sky Angel and the Mormon churches broadcasts of " The Church of Jesus Christ of Later Day Saints" a criminal offence too. And all this is due to an improper interpretation by a democratically elected liberal government who have been totally negligent and not intervened in the several years now that litigation has been ongoing on this issue. An issue that could easily have been clarified years ago by the Canadian government and parliament had they not been so remiss in their duties to pass laws that citizens can understand and obey. Instead they stand ready to jail Canadians and impose substantial fines on Canadians who did not understand very unclear laws. Laws so unclear that 2 Appeals courts (the highest level of courts in a Province) have ruled the opposite way to the Supreme Court as well as countless other courts all across Canada.

The question is just HOW can a government be MORE outrageous than this in pretending that it is a free and democratic government when the 5 top priorities of democracy all fail or partially fail making the current liberal government look little better than the government of Zimbabwe's Mr. Mugabe.

Canadians this is serious unnecessary government negligence and really is not passing muster with thinking Canadians. And I doubt if it will pass muster of a court if a lawsuit is launched, were they truly independent. The government is supposed to foster"Free Speech" (and the listening to that speech) but instead they are CENSORING what we can and cannot watch.

For those who do not understand their right to listen or view speech that conveys a meaning is also protected within the ambit of the meaning of the term "Free Speech." Of what use would it be to get on your soapbox and speak in a park if the police came along and arrested all the listeners. Whould you still say you had "Free Speech" because they let YOU speak but arrested all the listeners? That is precisely what is being done here.

How can anyone call this a democracy. Are you Sir or Madam being fooled by this farce? I am not.

When you come right down to it this is an incredible issue. It seems so obvious that we should get rulings in our favor with ease. It almost seems like a travesty that we are even put in this position og having to fight but that's not the reality. Either Canada has lost its way and is no going after objectives that are as farcical as Mr. Pervez Musharref's "election" or referendum or whatever laughable lie you want to call the deception by a dictator, or we too are ruled by a dictator. He gets away with this farce in Pakistan because we and the US have an interest in his deception to fight terrorism, but there would be EXTREME YELLING as to how wrong it was if we were not facing the problems in Afghanistan. In fact we yelled when he seized power.

Its the same thing here. This is an outrage and a farce but the Government is getting away with it BECAUSE they have managed to convolutedly justify what amounts to no more that BOLD CENSORSHIP and the Governments assisting a GIANT CORPORATION, BCE and Bell ExpressVu division to FORCE Canadians to watch their programming whether we like it or not, for their COMMERCIAL PROFIT and no other reason.

We will fight this to the last breath but we should not have to. Their SHOULD be a giant public outcry and while there are many newspaper articles in our favor, it really amounts to only a whimper compared to what it should be.

Democracy is fading fast in Canada and it really bodes ill for our children and their Children. And now we are left to hope for good honest judges at this level.

It probably wasn't broadcast in Canada by the government sanctioned broadcasters because it may have given us 'ideas' contrary to what we are being told. The information given may have caused us to consider the 5 points you mentioned and realize, that as Canadians, we are not allowed those fundamental rights and therefore may not be as truly democratic as we are led to believe.
