this is from a very brief conversation with D.F.. It seems the Ontario decision has been put off till Friday, and the crown and governments are leaning towards using a case that is under prosecution to have it used as a test case.

This may not be good or bad news. It does show that they agree that a test case should be the method to go. The trouble is the government will want to pick the worst possible case and of course our side will want the best possible case.

One case that comes to mind is the one in Manatoba, against Dean Love. This one has probably gone the furthest without having been ruled on and Charter arguments already made. While I do not know all the nuances about this case, I do not say it is our best one, but it is probably one that the crowns and government will agree to. Please take this as only my own speculations, nothing more.

Any way it seems we wait till friday to hear just what is going to happen.

No they don't agree to a test case and not a previous one.


They said since there were no facts in this Charter motion that the proper way would be to wait for a new case to be prosecuted and the facts of that case should be the guideline.


Please don't imply that the Government agrees to anything as they were contesting the continuation of the injunction very strongly.


Along with McKenzie from ExpressVu they did anything possible to persuade the Judge from granting a stay of the Injunction.


They are not agreeable to anything and you simply only have to look at the fact that they are contesting it.


Nothing has changed and and simply put they want to put everyone out of buisness no matter what and don't care about Canadian's rights.


They are not for us but rather completely against us


One should never lose fact of that.
