Paypal Affidavit

PAYPAL is issuing an affidavit to dealers for them to sign. I think they may start unlocking accounts. Here is the link where you can see it.

They called us and asked if we would sign this affidavit, without sending us a copy to read first. All the CSR said when we asked to see it first was "sir, are you interested in signing or not?". We declined to sign it and told them to go ahead and close our account.

You might want to get your lawyers to read this first, the part that says "has infringed, or will not" worries me a bit. "Has" meaning that you've never done such business, confuses me a bit. I may sound a little "conspiracy theory" but, just sounds funny, like a trap or something.

Yes, they have called many of the dealers. If you agree to the affidavit , they also want to hold 20% of all sales for a (6) month period in a rolling reserve. In (6) months and a day, they will start putting back the amount they held from the first day. If you decide to close your account, they want to hold 100% ,going back (6) months, of your funds for a period of (6) months for charge backs. This is great for them as they will be able to collect the interest from the funds that they have. Being that Paypal spends/looses more money then they take in, as reported by CNBC, this will help them out a bit the end with cash flow!

5. I understand that, pursuant to the User Agreement with PayPal, Inc. (“PayPal”), PayPal has the right to restrict my account should they become aware that I am in violation of U.S. or Canadian law. I further understand that, pursuant to the User Agreement, any controversy or claim that I might have against PayPal shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Further, the arbitration shall be conducted in Santa Clara County, California, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

What are you waiting for? I dumped my in protest a month ago... MO's only for me. Hit 'em where it hurts. IMHO this affidavit is designed to hold them (Paypal) harmless. What do you want to bet there is a full court press being put on them by Dave!
