View Full Version : Question for TTRK, regarding summons.

I got 2 letters, one cert, one standard mail on the same day.
I should wait for either another letter at least, or a summons before I contact an attorney, right? (there was no "proposed suit" included)


My thinking is that not everyone who gets a letter, gets a summons, correct?
So, I should wait to see if my name is drawn out of the "summons hat", rather make myself visible and have a lawyer contact them.

Thanks for your feedback, I can't figure this one out. :)

IMHO..You should contact a lawyer ASAP if you are going to.

1. CONTACT A LAWYER

2. have him send a letter claiming you do not have any devices in your possession.

3. State that iso programmers are sold legally by companies such as Microsoft

4. If you did have any devices state that they were not used for any illegal purposes such as they have described.

5. tell them to stop harrasing you and to direct any further correspondence to your lawyer

You guys need to take this abuse of the system serious, I know you don't want to spend the money on a lawyer, but if you don't you will regret it.

Its my opinion that its wise to contact a lawyer right away and see what he says. I don't know what they have accused you of or if there is any truth to it but by contacting a lawyer you are at least prepared. If the lawyer considers it unwise to contact them until a suit is filed, then he simply wont contact them. But if he considers it helpful, or useful because of what you tell him about your situation, to contact them for whatever reason then at least the opportunity is there.

If you wait until the suit (and I think most everyone will get one eventually) then you are REACTING to the suit rather than ACTING to opportunity.

That usually means you have fewer options available, for one thing.

So its my opinion that you should contact a lawyer right away and depending on what you tell him about your case, he has the opportunity to contact them or not contact them and to prepare himself for what may come. I believe you should ALWAYS keep all you options open to you and so seeing a lawyer right away is the best thing you can do.http://www.legal-rights.org/images/ttrk.gif

Remember folks that each situation is different even though they send this intimidation letter to everyone who purchased of a DSS site that they know of. Some cases are much better than others and the circomstances are different too. For instance ANYONE who has a subscription with them can be monitored much more closely (by their subscription file) than people who do NOT have a DirecTV® subscription. And if they get a plethora of CANCELLATIONS from the very customers who they are hassling like this, then they may think better of hasseling people.

Understand that this is 99% bluff and they have zero evidence of any wrongdoing or “theft” as they state but depending on what you bought, the E-mail letters you sent to the vendor, whether you reduced you sub after buying whatever or bought fewer PPV they can make a reasonable “circumstantial“ case against you that may be very costly to fight. And there is no absolute guarantee that you will win. Its a toss up when you go into a courtroom, unfortunately.

But a good lawyer can bring the settlement down or possibly cause them to drop THE CASE depending on many factors. If you have no SUB and you have a Dish Network system, that’s probably best since how could you steal their signal with a Dish Network system. There are many variables that come into play but this IS SERIOUS and they are pursuing these cases through to completion. The circumstances in your case will be determinative about your individual case.

If you plan to negotiate a deal Mr. Zakarian has lots of experience and can negotiate for anyone in any state. So you could start with him but he may have a referring lawyer in your state too if you need to go to court.

But the point is to DEAL WITH IT NOW, while there is lots of time.

And when I say negotiating with them, that may be a matter of your lawyer telling them to DROP IT, since you could not possibly steal their signal with YOUR DISH NETWORK system. It can mean many different things to many people's cases. They are all different.

Oh and I came back because I forgot to mention this.

What is GOOD for the GOOSE, is GOOD for the GANDER. What I mean by this is that if they can use circumstantial evidence AGAINST You (such as reduced PPV purchases) that goes the OPPOSITE WAY TOO. For instance just HOW could you possibly steal their signal if your subscription is with DISH NETWORK. You cannot steal DirecTV® with a DISH NETWORK (Echostar) receiver system. Its just not possible. So do NOT write that off casually because circumstantial evidence plays BOTH WAYS.

TTRK i have read a large number
of your posts on this subject.
as you know i get around to a lot
of sites and read a lost of posts

I appreciate all the input and see that it cleary points to contact a lawyer now!
I'm going to do that on monday and will see what he says.
I'll have info printed from legal-rights.org as well as other sources to help educate my lawyer and I'd recommend that anyone who has been helped by TTRK to PLEASE donate to the legal-rights fund! It helps everyone involved to keep abreast of the situation.
