View Full Version : Judge Rubin in Winnipeg tomorrow? Anyone know for sure

Hi Folks,

Well tomorrow is the 29th of July and as I understand it we may get a ruling in the case of Dean Love in Winnipeg by Judge Rubin on the Charter issue.

I believe Judge Rubin had said that he would rule and issue the ruling on the 29th. I guess many people are waiting on this ruling on pins and needles.

If the Judge in this case refuses to grant the Charter challenge, is this the end of any and all future Charter challenges?

Hi CVU,

No there will be other people who argue this issue in other areas but obviously it would be best if that ruling came in our favor right away.

Many judges have already said this in rulings where they previously found that there was no guilt on the "interpretation" alone so they did not actually rule on that. They made statements "in obiter dicta" but never needed to rule on the charter since the defendants were not found guilty in the first place. This is guidance for a court and will probably be considered but its not an obligation that MUST be followed. But it may well be followed and mentioned too.

The charter is NEVER ruled on if the judge can find a defendant not guilty for any other reason because a charter ruling actually "strikes" the law and finds it of no force or effect. So that is never done if its not required.

It would be difficult, based on all the facts here and previous Supreme Court rulings on the Charter for a judge NOT to find this an infringement of Charter rights. But as you are aware there is a general belief that this may NOT be ruled on under the law but rather due to political favoritism and things that should NOT be factors.

This belief was enhanced by the Supreme Court Ruling on CanAm since even while Judges were ruling in our favor time after time, some were saying that it would be reversed at the Supreme Court level by a Political ruling. And that seems to be exactly what happened.

So what was once scepticism became a major worry now.

So if the court does NOT hold in the Charters favor in Manitoba, there are still many other provinces where it can be argued. B.C. often seems to be the province where Charter Rights are upheld and the CanAm case there will still be heard in the fall.

What we HOPE for is for them to agree with the Manitoba court lending even more credence to the argument. But all is NOT lost if they don't.http://www.legal-rights.org/images/ttrk.gif

I think the last time Dean said he was hoping the judge would come back with the ruling on the July 29 day, but he also was aware that this judge has been known to just take more time if he has any doubts etc. So yes, Tomorrow is the expected and scheduled date for what should be his ruling. Let's hope all goes in our favour, as it should. If for some reason this gets delayed, we will then have try and be patient.

I may be wrong but I thought Dean felt very positive about how the hearings went, so he would also then expect a favourable ruling. Dean likes to go fishing and such, so he may not be around, but if he is around I am sure he will come and speak for himself here, very soon.

Whats important is what the Judge says in his decision. Obviously winning is the key but his reasons one way or the other is very important.

Hey TTRK!
Should we read anything sinister into it now being 48 hours later .. and no word yet posted here on Judge Rubin's July 29 decision?
Or was it just one of those numerous "adjournments" .. due to somebody being on holidaze??!!?

Hi Guys,

I suspect the ruling did not come out as it seems Mr. Justice Rubin has often not filed when he said he would.

Desn is gone fishing but he should be able to advise us as to what happened when he gets back.

it seems that this thread has been dropped down a couple pages so i thought i would just see if any of you guys have heard from dean or heard the outcome...

at last count r0f and rise were both planning on attending the court ruling, if either of you attended please let us know what the outcome is...
