Yep folks, the topic speaks for itself. If You show them (the "...group",lawyers) You're
scared You gonna end up real bad even if you settle. The amount of money you spend on a lawyer
and settlement will probably be greater than the one you pay in court if found guilty.
Hackers and etc. pay few thousand $ for commiting more serious electronic crimes, but only if they
get caught, and You my friend didn't do anything wrong nor did you get caught.Manage
the settlement-lawyer money so when the court appearance letter arrives(?) You can spend it
on a lawyer and fight like a man. Not only will You help Yourself but others. Being affraid
of things like that won't take You far in this case or in Your life.

Hi liquiDSS,

I believe that you are partially right in what you say and its time for a wake up call for many of the folks getting this outrageous letter.

I have said it time and time again that those folks who DID STEAL don't really have a good case and probably are better off to settle. But that is only a few people.

But there are a large quantity of folks here who NEVER DID THAT. People who had no idea that there was any contention in this matter. People who just typed in "Access Card Programmer" into 'Google' or some other search engine that came up with the names of folk that they may have purchased from. People who do NOT have a satellite system or who have DISH and not DirecTV®. Many of these people have a great case and certainly would NOT be found guilty on the mere "Suspicion" that DirecTV® have nothing but an invoice for. And Invoice is NOT proof of any wrongdoing for anyone. This is a total bluff on their part because they really have no proof in about 95% of the cases. And in the other 5% its all circumstantial proof, by deduction. That could win but it could NOT win too. Its really a toss up.

So I suspect that the vast majority of people who get these letters have done nothing illegal and could win their cases in a court.

When the settlements were for $1,000.00 or even $1500.00 it may have been easier to just settle and move on EVEN if you were being wronged and falsely accused. Economics made it the cheaper solution unfortunately.

But with the hardening of DTV's apparent attitude and by what seems to me to be their last ditch attempt at making this "harassment pay" for them, I no longer see much advantage in settlements. I believe if a few of these innocent people will just fight them instead, there will not be much difference in the overall cost AND there is a lot of satisfaction of not letting "economic terrorism" walk all over you. Its almost like "blackmail" and if they succeed the first time I would think they will be back.

It must have been very difficult for an innocent person to make a deal and pay up because of the economic pressure and the fact that justice costs so much money but when you KNOW that the cost of a deal and the cost of fighting are not very different, I think you will see good people fight every time. And because of the greed and the unwillingness to negotiate, I predict that we will see some WINS in court now by many of the people who broke no laws and are in an excellent position to prove that.http://www.legal-rights.org/images/ttrk.gif

To the fighters, the very BEST of LUCK to you and you sure will have a lot of people rooting for you behind the scenes. This is AMERICA folks, and blackmail is illegal here. So I wonder who is really the victim here.

I find it kinda of funny that no one has stepped forward with a suite letter naming a date, location and bring this with you. I received the first letter, wrote them a letter dening illegal use. 4 months later I get a call stating they received the letter and to have my Attorney contact them. He stated he was an Attorney in Seattle representing DTV, he did not state the firm he worked for. I received another call yesterday asking me to contact them or they would have to recommend to DTV that I be Sued again he did not state the firms name. I have An Attorney calling them today. But where are all the suites? Is everybody settling with these tyrants? Surely somebody has gotten a summons by now, these letters have been going out for a while now. This is an update, I went to Yarmuth's web site the Guy claiming to be an Attorney was not listed on their site. Again he did not state who he worked for, but the letter I received back in march was from Yarmuth Wilsdon.

Hi Trapstir,
I think that 100% of "I know what's going on" people find the above situation funny
because nobody's gotten a suit letter yet. I might be wrong with the "nobody" part
but the point is that 99% of peeps that rejected or didnt take any action concerning
the letter are not being sued as of now and there's a strong possibilty their cases will
never see the daylight. First of all they're trying to scare everybody because the more
folks they scare the less they have to face in court, beleive me they won't sue 100 thousand +
people. Second thing is i dont think they wanna sue anybody(except the people that bought
programmed access card) because if you stick to the truth(not guilty, i'm innocent, for
educational purposes, etc...) they know they'll loose. Another thing is it takes around
a year just to start the case and if you play it right extra few to see the end(ever been in a car accident,
vehicle insured by sh*tty company?yeah, sounds familiar). I'm sure that first they wanna
get all the money there's to get and sue couple of innocent folks just to see if
it works out, but it's in Your hands not theirs even if doesn't look like it, so handle
it with care and you'll avoid paying unnecessary consequences.

I received a summons last Friday....Yes they are real.Its a summons for Federal Court in Florida.My first reaction was outrage.They are charging me with three counts{Unauthorized Reception Of Satellite Signals In Violation 47 U.S.C 605a}....{Uauthorized Interception Of Electronic Communications In Violation Of 18 U.S.C 2511(1)(a)....{Possession Of Pirate Access Devices In Violation Of 18 U.S.C. 2512(1)(b)}....This is absurd,The evidence cited is that I purchased an UL PRO UNLOOPER from Fulfillment Plus for Shutt Inc.I won,t detail the specifics of my case except to say I am innocent.I have discussed the matter with four attorney,s.One says to settle with the weasel,s as it will be to expensive to fight.One (Who deals only in civil cases)said if could be very expensive but could get attorney,s fee,s with a win.(Of course I have to pay up front and if and when I did win I wonder how long it would take to retrieve my money.)He also said that Federal cases sucked because the Judge,s were usually very arrogant and perceived themselves a step above everyone else.He also said the procedure inFederal court was much more stringent than county court and everything had to done right on time to avoid problems....It does not look good ,I may have to settle toavoid stress and economic calamity.I would love to fight but it looks as if I may be in over my head....My thought,s......THIS IS JUST WRONG......D/TV,You may win these small battle,s against your so called end-users but this will come back to bite you in the ass in the long run.My six year subsciption of $60 a month is over and anyone else I can convince.I might have been a customer for the next 50 years.....Do the math dirtbag's.......What,s next,Maybe the record companies will file Federal cases against every kid who has downloaded a song from the internet and drag them to Federal court to suck a few dollar,s from there hard working families saving account. >>>YES THEY ARE SENDING SUMMONS,IF YOU RECEIVED A "LETTER" DON,T BE SURPRIZED IF ONE COME,S TO YOUR DOOR.

How many letters did you receive? Were you in any contact with them. Were you trying to settle with them?

Thanks for your reply zeta7, finally someone confessed publicly about it. First
thing is i'm really surprised that some of you throw it away and think it will go away.
You gotta think positive but if you're not ready for it you better settle the day you receive
the letter. If it ever comes it takes guts, time, money and a good attorney not the one that tells
you upfront "...the best thing to do is to settle..." because if you're innocent it's not,
except if you're really really broke. Small amount of peeps are being sued at this time and this is what i've
said. Do you people really think that if they loose almost every case they gonna continue doing it?
They will? Sounds fine to me. You're being pushed by them, you'll settle and this is what they want. Just by reading posts
on this forum i can tell that almost everone that posts here is affraid and yep they can tell that too.
Many right people said it's a game, but i guess not everybody can coach his mind.

I had my lawyer contact their attorneys a couple of weeks ago. I received the initial letter back at the beginning of the year. They stated I was in the "to file against" stack, and that I have till mid August to settle for a absurd amount, or they will file on me.

Hi JD490,I received two letter,s.The first was in Feb. and the second came in late March.I decided to ignore them based on advice from others.The general belief was "How can they convict you based on a such circumstantial proof as a purchase from three years ago."This sounded logical to me as they were sold freely all over the internet. I spoke today with an attorney with some knowledge on the matter,s that D/tv is basing there attack on.(1)It is illegal to have in posession one of these device,s that are used to primarily pirate access cards.Also it is illegal to assist someone in the purchase of one of these device,s even if you never used it.(2)Yes,You may be able to fight and still be found guilty and a resonable judge may say the damage,s due are much less than the $3500 they are generally asking for.But,To fight and take it to this point you could resonably spend $10,000 to$15,000 in legal cost,s.(3)This is my opinion...You could fight based on constitional issue,s,illegal evidence,and a number of other untested issue,s but have a "Fat" wallet.Everyone has to keep a level head and do what is best for themselve,s and family,s.Do I want to fight like man.Of course,But I won,t go in swinging wildley. "Good Luck" To everyone involed with these issue,s.

Thanks for the answers. I just received my first letter. I am hoping my attorney will be able to work something out less then 3500.00. I am not in a position to fight this in court right now. From what I can see is an upward trend that they are becoming unreasonable in settling for lower amounts this could be do to the mass of people settling there cases and they see its easier they thought it would be at first. I know one thing if they ever are successful in stopping people from hacking there system there prices for a subscription will never go down no matter what they say. When they merge with dish I know they will be raising there prices. I would think it would be much more productive to settle for subscriptions and signed agreements at least 100 thousand people would be subscribers. I know one thing I have for 7 years told people to get Direct TV now I will never ever have a good word about these people. Sense I know dish will be merging with them I will only indorse cable TV now.
