It doesn't matter what the DTV lawyer thinks...you are going to settle so have your lawyer work out the best settlement he can get.

Hi Guys,
Don't you understand how this is played? The only way they will settle for less is if they think you will go to court and beat them. They are aware that their evidence is not that strong. They know they cannot prove you stole TV. But they are a hell of a lot closer to a win today than they were when you started.
Your lawyer told them that you have an emulator but did not use it.
Use it for WHAT?? Was it bought to steal TV? If that's the impression they got then they will be tenacious as hell.
If they believe you purchased an EMU for lawful purpose, to assist in developing a smartcard for security, THEN they would be worried. But it sounds to me like your attorney did you NO GOOD and gave them answers to things they did not know stating out. Frankly that's very bad and you got exactly the services you paid for. NONE!
In fact it seems you got a disservice.
From what I hear you now need a very good lawyer to negotiate and get you ANYTHING below the minimum $3500.00. In fact you have screwed it up so badly at this point that you may want to consider accepting the $350.00 and get it over with.
But folks this is a perfect example of what NOT to do.
Do NOT give them any info as to IF you have a device or anything. They should be told NOTHING.
And its your lawyers job to CONVINCE them that you bought whatever, if you did, for lawful purpose and can prove it in court. If you do NOT make them think you will go to court against them, then they know you will settle and the JINX is UP. Cant people see that. If they believe for even a single moment that you WILL NOT go to court, then you have lost. Its just a matter of HOW MUCH they can get.
You do not negotiate that because you are a nice guy they should go easy in you. The negotiation is about ONE THING. That you will destroy them in court. ONLY!!! Nothing else matters.
Folks I do not want to but in or be harsh but if people do NOT understand what this negotiation is about and how to accomplish that, then either get a lawyer who does (a good lawyer is WORTH THE MONEY) or give it up and settle. If you CANNOT convince them that you will BEAT THEM IN COURT then you will LOSE bigtime. The only reason they will settle for a low amount (say $1200.00) is because they believe they may lose if they continue and the lawyer wants to make something. And they KNOW this is cheaper for you too but YOU ARE PISSED and they have better take what they can get before they get nothing.
Anything less and they will win.

You can ONLY win this from a position of strength and most have that in the beginning since they have little evidence (and that varies). But if you did not steal or have a situation where they cannot prove any theft then you can WIN (THE BLUFF) but you had better not go to court on a LIE. You need to bluff them that you have a strong case and WILL go to court, but if you are guilty then you had best settle for the lowest cost you can. And they cannot tell if a PRO negotiates for you because the opposition knows NOTHING about you. Any thing they can learn about you is BAD for you. A good lawyer knows this and tells them NOTHING, pushing always for disclosure of their evidence and answering NOTHING about you at all. The best of Luck people but watch your position carefully and give them NO information at all. That is your best chance to win overall.
And remember guys, the ONLY one in a EXCELLENT position is the person who did not steal, is not lying and that shows through. That is why YOU should never talk to them. They can learn from just the inflections in your voice and that alone is too much to give up.

So what your saying is give this new lawyer the $500 and let him try to work a settlement , knowing my 1st lawyer could not get this guy to move?????
You have to make your own decision. Your second lawyer you said knew the DTV lawyer and perhaps because of the relationship he might be able to work out a better settlement Why don't you ask him what he thinks he'll be able to settle on.
