I just received one of those harrassment letter from Dave's attorney (based in Seattle) today. It was sent to my PREVIOUS employer via certified mail. The receptionist there signed for it.

I read the docs from legal-rights.org already. I contacted the lawyers in California. Here are my options:

1) Settle with them. Out of his 90 or so clients who received the letters, about 90% of them settled. They paid somewhere between $1,000-$2,500.

2) Submit a sworn statement saying I am not stealing their signal. Abouy 6-7 of his clients have received waiver base on this. He recommended me take this approach just to be pro-active. He charges 175/hr and minimu 3 hrs.

3) Ignor the letter. Since it would be too costly for them to sue everyone, it might never get to me. But they might keep track of this and sent a 2nd or a 3rd letters again at which time they might not be as easy to deal with. If it ends up going to court, it might cost more.

So, my questions to all you guys who been thru this:

a) If you ignore the letter, did they send you a 2nd and 3rd? If yes, how many months after and what is the status?

b) Anyone settled and how much.

c) Anyone wrote the sworn statement?

The bottom line is, what should I do? I need some intelligent commetns.

I recieved a letter like yours 7 months ago. My situation may differ though, being that I work for a dot-com and am constantly surrounded by quasi-public machines. I bought a ISO programmer and a few "white cards". I figured that if they ever contacted me again, I would just explain that I was wanting to find a secure and pratical security measure for our computers and the equipment I bought didnt work so you threw it out.... hence, my first inquiry to security smartcards, when looking for equipment, ending up being a DSS "dont metion by name" hacking tool.....blah, blah ,blah

Im guessing that your name is on a billing statement for one of the many companies selling hardware that got busted? Mine was!

Ignore the letter, for they never contacted me again. Its a scare tactic. All they know is your name and address and that you purchased some smartcard programming equipment.......it wasn't flashed with code when you bought it, right.....you were just looking for a smartcard security programmer...for your companies computers...;)


If your really paranoid, however, take down your system and sell it to me.....I'll start the bidding at 5 rupies...

Thanks for the info. Well, some people received follow-up letters and so. I am interested in knowing what percentage of people received these followup letters. Also, the fact that it was sent to my previous job and a secretary signed for it, would that help?
