I think we need to go to trial. Once we win, it will dramatically change the outlook. We need to see little people winning against the giant. Once we see that they can and will be beat, then more people will stop settling. They will not quit as long as people are settling. We are our worst enemies right now.
What we really need to do is group together. Instead of 1 person against the giant, we need to form small groups of people and fight. If we can get groups of 10 people and then as a group hire a good lawyer to represent all of us. Instead of paying $3500 to settle, each person could pay $2500 to a lawyer. That would be $25000 for the lawyer. He could file a counterclaim representing all of the group. That is what DTV is most afraid of.
Individually they will beat us, which is what is happening right now.
We need to start posts and getting groups together by area. This will work. We just have to get a good lawyer and go to trial. Again they will not stop the letters as long as people are settling.

I have been reading all of this in preparation for my letter, which is sure to come, but has not yet. And I agree 100% with that statement. Hell, you might even be able to get a lawyer to work on a contingency for a LARGE countersuit?

IMO. DTV will drop any case that they have against a small guy end user. It they feel that the person will go all the way to the wall and fight them. That's the last thing they want is to lose a few of these cases.If that happens their blackmail letters sending will be over. And they know this. But like you said someone will have to be willing to spend a lot more money fighting them then just setteling.
And I for one can not risk that kind of cash. But I hope someone can.
An I will be more then happy to sent a few bucks.

Most of us receiving these letters are just that, little guys.
Admit to nothing, but acknowledge receipt of your letter. Continually place the ball back in the court of dave's outsourced law firm. Drag this thing out for as long as possible and don't give a red cent to anybody until you actually get summoned to court (which is likely to NEVER, EVER happen to you as a little guy.
And as for the class action route, leave that to the bigger fish to fight...Those who have a record of possibly making money off this hobby. As a little guy, I wouldn't want my name grouped with anybody I did not personally know.
...and no, I'm not a mole as someone suggested earlier ;-)
I simply believe that your best defense against dave is to legitimize that dish on your roof. If you're not paying for basic, then why the hell would you have a DTV dish on your roof? ...Talk about incriminating evidence :gg

I wish someone would set this up. I would throw a $100 bones in the pot just for someone to tell dtv to go ---- themselves and fight it. I just have a feeling that people that are willing to go the distance and spend money defending the case will get the case droped.
Maybe we need to pool money together to basically sue those mother----ers.

At least here people are talking about other options. We are all basically in the same boat. If we had big bucks for a lawyer or settlement, then we could afford premium tv as well. If we could get a lawyer to represent one person all the way and set up a defense fund, I'm sure alot of people would contribute, myself included. All it takes is one case to set presidence for others. IMHO of course.

I am just waiting for Dave's next move. As far as I am concerned I am not guilty of anything and I owe Directv nothing. I don't even owe them an explaination of what I have done with any perfectly legal products thay I may have purchased. They will go after the wrong person sooner or later and will lose a countersuit and end up paying big bucks for attorney fees and punitive damages.

That moment may be at hand without giving to many details (I'll do that when the time is right) But Dave's boy's have sent a letter to the wrong person. This person has a lawyer right now the partys are waiting for dave to file his law suit, and when that happens look for a counter suit..DUMB DUMB DUMB

Launching a countersuit doesn't mean anything. I just hope the guy has lots of proof. Remember a judge is the one who decides the case.

Proof what proof? they got the wrong guy and he can proof it! and he's mad as hell! I think its kind a funny for real not that he's being sued for something he knows nothing about but that dave's guys could make such a BIG mistake.

In addition to a civil countersuit, it shouldn't be much of a stretch to file a criminal suit against DTV for extortion. The letter in itself should be evidence enough, combined with experiences of people trying to deal with it, hopefully will open the door for a massive class action suit. If the justice system takes the appropriate response, Dave should be forced to pay back all settlements that have been reached as a result of legal threats based on flimsy evidence. If more people refuse to settle, maybe we can take the profit out of Dave's threat campaign.

in my opinion ,depending on what the proof dtv has,the judge will be dtv worst enemy.I would bet that up to 80%would be thrown outfast,but im not a lawyer.
