Got this form another forum. Has anyone else heard this???
It has been brought to my attention that DTV has instructed their attorneys to send the 2nd follow-up letter within 10 days and then file suit.
It has already started to happen in many different parts of the country, both in Florida area and Houston TX.
Also, and this is very very important.!!
**Please be advised that Though DirecTV is filing civil suits against the alledged "defendants" for stealing satellite transmission. This is also a "Federal Criminal Offense", punishable by a fine of up to $10,000 per occurrance! & Jail time!, plus a host of other related issues that go along with this charge.
for the record. It appears that many of the individuals who have entered into these "settlement agreements" with DTV, have all been charged criminally with the violation of the statute!!

What about all the people in the past whom settled with cable companies.Dont you think they would have been brought up on similar charges. Dave's wick is burning to an end .Class actions are coming soon....,very soon...

ROFLMAO!! Man, the histeria and BS that flies around here... They havent even filed any lawsuits against end users yet, and they are already talking about criminal charges? jeezus... I got my 2 letters months and months ago,called them and told them to prove it, and nothing has happened yet, and until I see that summons come, this is nothing more then a scare tactic... As for all the pacer records being posted around here, those could be users who bought hundreds to thousands of the devices, lets get realistic here, most of the scared people are users who bought 1-5 devices, and if you think a huge corporation is gonna waist their time going after someone like that, you are not in touch with reality...now if you bought alot of devices, you should possibly worry...This gets me back to the topic at hand, criminal charges; if you bought alot of devices, its possible that it would hold up, as for the low end users, you have nothing to sweat.

I got the offical papers. I'm waiting on my court date now!!!!
But you do have one thing right, Wait for them to offically file agaisnt you. Then you will see how stupid they are. Most of their so called evidnce is BS. You've just got to prove it.:cool:

Directv is a private company and have no power to launch criminal proceedings, only civil ones. They can consult with a legal agancy, however it is not up to them to decide if criminal charges are to be laid

Arlodawg, cool man. So i take it this means that you got some kind of papers, but you havent actually gotten a official summons yet with your court date? I highly doubt itll come man, unless you purchased ALOT of devices...

Cant you read sir. He says "I got the offical papers."
Court docs rarely contain the trial date and usually call for a pre-trial conference to lay out the issues, find out if its a Judge alone or a judge and Jury and THEN set a date.
So do not take it this means something else. It means he got the OFFICIAL papers, the Subpoena.
You are continuously trying to mislead people when in fact there are over 10000 lawsuits filed already. Why are you doing that, what is your game??
Being in denial about it as you seem to be WILL NOT make the lawsuit go away. I have pointed you to the actual lawsuits more than once before yet you continue to be in denial. You can HARM newbies by saying that when its in fact, not true. They are filing lawsuits DAILY!!!
I do not know what your game is but you cannot be in denial when the actual lawsuits are published and it is very misleading to do so. Please DO NOT do that on these forums. Its not a matter of opinion since I have referred you to the suits multiple times now.

Rise that is correct however they can file a complaint with law enforcement. I did once and had to be sworn in. Then law enforcement did an investigation and arrested the Crook who now sits in Jail.

Hmmm....I really doubt the criminal charges but would like to do a search in PACER to see....however can't figure out how to search. With Civil it's easy you just search for "D****TV" as one of the parties....how would I serach with criminal?

Many of the settlements I have seen have a line in them that says something like that you entered into the agreement without admitting you ever owned the device and are entering the agreement solely to avoid legal proceedings. I find it hard to believe that they would put a line in the settlement if they intend to have criminal charges brought against you. If you think about it, once you settle they get their money and *probably* get you to stop pirating their signal. That's all they want. It seems they don't even care if they lose you as a future and/or current customer.
These cases are also much harder to win as criminal than they would be as civil. The whole "beyond a reasonable doubt" and "preponderance of evidence" issue comes to mind.

not only that, but i highly doubt dave or the law firms wants you be charged criminally. think about it, once word gets out that people settling are being charged criminally, their cash cow would likely stop, at least for people researching the matter. who the heck wants to settle if they are going to be charged criminally? i know i wouldn't.
plus, i've been researching the matter cuz it got me scurred, but over several forums where it is mentioned, the source of this rumor is ezekiel over at dssfilexchange, and he, as GS2 pointed out, is runninrebel.

MaXXXXXuM is out to lunch since they have already filed hundreds of civil suits, each one names from 7 to 15 or more defendants so they are suing all right and they have sued over 1000 people so far. His turn will come.
If anyone doubts it, just call any of the lawyers posted on:

and ask them if any defendants have been sued. Almost all of them do have clients who have been sued. People make these statements without knowing what is going on and to reinforce their HOPES but it is happening and they have filed hundreds of suits naming thousands of defendants unfortunately.
I wish it was not true but what is the use of telling people that its not happening when it IS.
Pacer ONLY puts up filed suits, not other things so each pacer entry IS a filed suit and often is against 25 or more defendants because it costs them $150.00 to file and they save money this way.
I find to a real crime to have these people post this false information because they wont come back and post when they get their suit. They are too embarrassed.

For example the first civil case for FLORES names 8 defendants but is one case.

I got my civil summons served yesterday. They are asking for $10,850 for purchasing one emulator. 17 people on the papers. How are most of these cases turning out when they go to court? Is Dave winning any?

I am so fed up with the brainless F U C K I N G morons who keep depreciating the value of these letters and the fact that DirecTV™ is suing people left, right and center and according to the lawyers that I have posted on my site are already suing hundreds if not thousands of people e RIGHT NOW.
Their day will come and here is an example of the type of letter I will later get from them. I got this one today and since it IDENTIFIES nobody, I thought I would share it with you

HIS LETTER
Hi there,
I was directed to Legal-rights.org after receiving a "letter" from the End User group that threatened legal action for DTV piracy. I chose to ignore the letter and I thought everything was ok, this was months ago. I just received a "Summons" from a courier last night (9:30pm in fact!) from a law firm in Thousand Oaks, CA (I am located in the LA area) stating that I am...
"...required to file with this court and serve upon plaintiff's attorney ("law firm & address", which I will provide if necessary) an answer to the complaint which is herewith served upon you within 20 days after service of this Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint."
Now the problem I have with this is that 1) it is only signed by an assistant at the attorney's office, 2) the Clerk's stamp of filing has no signature on the line, 3) there is no District seal in the required spot, 4) it appears to be a xerox, 5) it is NOT on legal paper, 6) a Magistrate Judge was not specified in the section denoting which judge was selected.
I'm not a lawyer by any stretch, but this looks fake. I have called the United States District Court Central District Of California and requested information on the case (providing the penned in case number) to see if truly this has been filed. I'm not too sure what to do here but I cannot possibly fathom retaining an attorney for something this preposterous.
According to the claim, I purchased a programmer last year from_usacardcleaners in New Jersey and they are claiming that what I did was illegal. I program all sorts of hardware for a living and when I purchased the item I was forced to_"Accept" their terms, which included a statement denying ANY use of the item in an illegal manner. Now since the 7816/Atmel reader/write I purchased was available legally (I assume or they would have shut them down long ago) am I actually in trouble? These exact same units are available at MANY sites.
I am absolutely befuddled here because I'm not clear on how they can file a claim on an assumption (or so it seems to me). I have maintained a DTV account for 4 years and have purchased every football package and thousands of dollars of ppv fights, but apparently they don't cross check these things? Was it actually illegal to purchase that item from that site (it was one of the cheapest prices for the unit and I assumed it was_offered legally)? I'll most certainly be cancelling my subscription when the football package expires!
I assume I may need an attorney for this if the case has actually been filed but I don't understand how a case like this could get filed on the legal purchase of a WIDELY used piece of technology. I was told that I simply got caught up in a dragnet and NOT to speak to them, but this is starting to look serious.
I can provided you with a copy of this "Summons" if you would like, just tell me how you would prefer the format (scanned image I suppose would be the best).

Now this guy has got 20 days to do what could have been done MUCH better if more time were available which it originally was. He needs to do interrogatories, discovery and plan and formulate a defence all at the last moment and WHY, because he listened to the unknowing A S S H O L E S who told him to forget it.
It is such a shame that people are so willing to listen to the idiots and only because its the comforting thing to no, if not a real life assessment of good sense.
Good luck sir, "but why do today what you can put off until tomorrow" is NOT the best thing to do in this situation.
