I hope this poll will help people like me. I received the 1st letter and don't know if I should wait it out, have a lawyer write a letter...etc...
So please only vote for the one that you personally went through.

My scenario isn't listed.
Ignored the certified letter, received the second 10 days after the certified letter went back. Sent them a letter denying everything and basically telling them to fook off. Haven't heard anything in six weeks...

I sure would like to hear from a 3rd party that knows the detials about the person that lost or maby what the rumor is on why he lost & how far in court did it go?

I recieved 2 letters a week apart back in March. Both came regular mail. I ignored them both. In October i recieved a third letter with a draft complaint which also came regluar mail. I have decieded to ignore them all until i am served. Will they have to serve me prior to sueing me?

I have also received 2 letters one month apart coming by regular mail and the second being the blank suit. I have decided to wait until they can verify that i have received anything from them by certified mail. This is probably a bad idea but its to late now. How many people here have got 2 letters and not had to sign for them? After all how do they know you have received it! They should make a better attempt to contact you if they want you to settle.

I do not know why you think this but they do not have to send any mail certified. In fact they do not even have to provide these warnings but they do so that you will know what its all about.
Only the actual suit has to be served by a process server and the rest is perfectly valid by US mail.

This was the same thing that happened to me. First letter came fed ex and was left on my mom's driveway in the rain. second came usps regular mail. Didn't sign for either of them and the second letter came with a draft complaint. In the complaint they said I purchased things that I have never purchased. This leads me to believe that they don't know what I bought just that I bought something. I don't even own a dish or reciever and have never subscribed to DTV nor will I ever. I cant afford a lawyer at this time so I decided to ignore the letters and let them sue me if they think they have a case against me. Might be the wrong thing to do but I wasn't going to call them on my own and make a fool of myself. Time will tell. Hopefully when the time comes I need that lawyer I will be able to afford them. :(
I urge all parties that have received letters and signed agreements with DTV and those that have received letters and not signed any agreement to contact this firm. It is our only hope of defeating our GOLIATH in this matter...

Yeah, I'm curious about the guy that lost his case. Might be fake though, who knows.
Exholio: I would put that as received letter and settled.
So far, my first letter came by certified mail and my girlfriend signed for it. I'm ignoring it and going to see what happens.

Your option of "Had lawyer respond to 1st or 2nd letter and nothing happened yet" is fine, but you are missing an option..
RESPONDED TO SECOND LETTER BY ATTORNEY BUT THEY RESPONDED WITH A THREAT TO FILE SUIT.
That is what happened to my friend. He ignored the first letter, then got a second letter about a month later. He responded to that letter denying any and all involvement and asked DTV's attorney for proof or cease and decist.
He got back a letter through his attorney with a credit card record. This was enough to make him settle, although, the credit card record did not specify what was purchased.
The problem is, that if they have a credit card record, unless it is specific they have nothing on you other than you made a purchase, which in itself is not illegal.
But, if they KNOW what you bought, and they were not showing their hand that this point, then you have got a problem.
Keep in mind that if they sue you, and you lose, it is going to cost a LOT more than the $3,500 settlement.
The other issue is that they can subpeona your family to testify. So, unless you and your entire family are ready and willing to lie under oath (kind of like Bill Clinton), you should not take it that far.

Keep something in mind folks.. if a letter is sent via FIRST CLASS, then the rule is that "a letter sent is a letter received".
While this may not be fair or true, it is the way it is.

I don't know what I would've done if I was in your friend's position. This is a bad poker game where we don't win anything but can lose a lot and we don't know if they are bluffing or not (bastards!)
Don't know how they would prove they sent a letter if it was by first class. They would need some sort of documentation on it. IMO.

Hi Folks,
Remember that something was purchased over the Internet.
Therefore there ARE no signatures on the credit card receipt. So that DOES NOT provide proof of a purchase. Many are assuming it does but I cannot see it when there is no signature involved. Where is the PROOF!!!!

The only thing I can suggest is this:
Only gamble on what you CAN lose. If you CAN'T lose what you are about to gamble, don't do it...

I say ----'em. No one should settle until served. Look at the percentage of people that have been served. Once you are served it becomes a finacial decision. It is obvious to me they are not too ansty to just sue everyone they send a letter too.

So we've heard, but I still have yet to read from one individual end-user, not complicit in defrauding dave, who can claim to have paid more than $1 in judgement.

Yo brain, this would be tantamount to letting the terrorists win dotcha think?
The minute you start worrying about your family turning you in or possibly testifying against you is the minute dave has won the game.
Besides, what's in it for your accusers? Is dave going to pay them in order to garner their support in helping to convict you, the end-user? ...and even if it's an enemy of yours you fear will testify against you, let it go that far and let your lawyer shred your accuser as having defamatory motives.
Scare tactics are the one major component of this game dave obviously has working in his favor, so let's please not help to perpetuate any of these half-truths.:mad:

A first class letter is not in anyway 'proof' that you got it. A signature by you is the only way they can prove you got anything. There is a reason process needs to be served by someone with a license or a constable. Otherwise people would just say they sent the summons via first class mail and get default judgements.

I was just curious about all the people ingnoring these letters and not hearing anything ?
Has the class action slowed dave down?
How long has it been sincee the ingnored second letter?
