is a programmer illegal?

I was just rereading the summons that I received. It lists one of the devices I purchased was a "NexGen & UL Pro w/SU2 combo".

I dont understand this...the device that I recieved was a NexGen programmer. So I dont know what the hell a "NexGen & UL Pro w/SU2 combo" device is.

Is a programmer as "illegal" as an unlooper?

i own a netsignia reader/writer
it sure isnt illegal.
you do need a lawyer one who is
familar with these cases.
if some of threads i have read here
are even close to true. some lawyers
dont have a clue about the issues in
involved.

Let dave take you to court and if it even gets to court, let your lawyer then argue on your behalf. Keep silent and offer dave's lawyers nothing that can be used against you.

After dealing with this myself I would hire an attorney that has lots federal civil trial experience under his belt. The attorney doesn't need to know how to program a smart card. Don't listen to advice on here what it might cost you or how easy it might be for you to win only a good attorney can give you advice. The nexgen programmer was not a unlooper they obviously don't know this, or are trying to make you look worse. Many loop holes in their case that need to be explored. You need to get them to stipulate that a programmer has other uses then just hacking. This will create hole then if they can't find anything else that proves you used it to hack they are in a real bad spot. The time may come when you need to reveal you purchased the device and prove it is not an unlooper, but just a standard ISO 7816 programmer. If you enter your programmer into evidence you are also asking for trouble because the device is their in front of everyone. You might want to try and have your attorney subpoena one from some place else, or someone else maybe one of DirecTV's confiscated ones.
