View Full Version : Can I sue a person who posses an "illegal device" for $10,000?

Why would I be any different than dave if I sued a person for violating 18 USC 2512(1)(b)? Heck, I could probably get much better evidence than them in most cases. It seems I would have a right to do so since my subscription prices have went up because of illegal access, and therefore I would have an interest in regaining some of my lost dollars along with "punative damages". Where does the law state only Dave can do such things?
Which leads me to this: Where does the law state Dave cannot be held accountable for these laws? Seems to me they demand the "illegal device" for settlement. Let me think about this... Yup, I could send an "illegal device" to them and it would be going through the mail, and yes, they know it is primarily useful for surreptitious interception of an encrypted satellite signal. I suppose they are immune to these laws. I don't see where the law says "except Dave" on the end.
Oh well, I tried... :(

If I beat Dave to the punch and sued someone using the same evidence Dave has (of course with nothing more to back it up), can they sue that person again for the same thing, or would double jeopardy apply? I'm not sure how double jeopardy applies to civil suits. Maybe something to look into as a last resort, although this would definately be scraping the bottom of the barrel if you're feeling unlucky enough to get a summons...

You can't. You have not been hurt by somebody else using 'illegal' equipment to pirate DTV.

Unless you borrowed a card programmer and it caused you Physical or Emotional injury I would say you don't have a case.:Z

What if the solder side was not done neatly and you get a puncture wound while handling the device? You know how sharp the solder side of a board can be!

Unfortunately, I don't think DTV would be held responsible for the dangerous and improperly manufactured illegal device.

Yeah... So maybe you can't sue just them. You could name them as a codefendant because without their poorly protected signal, you would not have ordered that dangerous and badly constructed device.

It seems that it would be no different.
Your suit, like dave's suit, would eventually be dismissed and thrown out as frivolous unless the person went to incredible lengths to incriminate himself in attempting to defend himself.
If you as an individual were to sue thousands of people alleging knowledge of wrongdoing, you'd undoutably find one or two willing to settle if you scared them properly. But because you're an individual, most people would take offense to your extortion attempts and countersue you.
The fact is, there will always be low-life scum lawyers willing to put their names on even frivolous lawsuits, as long as there is some potential for making money. It's all about the money people. Keep your money and if you choose to pay a lawyer for anything, make sure you sue to recover your lawyer fees as a result of dave's frivolous lawsuit.

i can call 911 and say you hit me and you will be arrested for assualt/battery
do i have to go to court ...no.... do you ?? you betcha
do i need a lawyer ? no but you sure do ...if it is a class A misdemenor or something worse ...you cannot even get before a judge without one...WHO pays ? not me... even if you get off you LOSE bail money and litigation related costs
now to my point ... can i sue you for anything i want ..yep
will it go far ? DEPENDS ON HOW MUCH MONEY I WANT TO SPEND
