Hi,
I started this thread because the other FLA thread looks dead. I don't think anyone has good news! One lawyer I talked to in FLA, has 200+- clients and 21 in court, the other lawyer didn't return email. It looks like this blackmail plan is bringing in a lot of money for the DTV lawyers and others. I didn't really hear anything positive when talking to the lawyer. I was not encouraged by what I heard my cost were going to be.
Today is the final day, I must answer back Dave's second letter. Any suggestions? It appears to me at this point they love it, if you don't answer back because they can file a summary judgement, and get their money from the courts. If a Lawyer contacts them, you look guilty, especially if you use one from the forums.
If you have contacted the end user group, directly, I would like to hear how it went, before I call them.

They don't get a summary judgement unless they actually serve you and you don't answer. The letters have nothing to do with getting a judgement.

I have spoke w/ the enduser directly twice...The first time was on the last day I had to respond which was around Oct 5th...Dtv lawyer did not ask me any questions and just stated that they have information that I purchased an unlooper on July 6th, 2000 and Dtv wants 3500.00 to settle this matter...I did not say anything about whether I purchased the device or not...I informed the lawyer that I do not have 3500.00 at this time and asked how much time I had...The lawyer said that nothing would be done at least until the beginning of Nov...This atleast gave me some time...In the mean time I joined the class action lawsuit...After a month had passed and no good news from anywhere a attorney said "settling would be a good idea"...Called Dtv lawyer back and told him I was planning on settling and to send me the agreement but it would take me a month to get 3500.00...Now I have until Dec 15th...Hopefulley some good news will come soon because I don't beleive I can stall any longer...In my opinion I don't think it's a bad idea to call them...They did not ask any questions and I admitted to nothing...It might gain you some time!

How do you figure it gained you any time? They hadn't even sent you the second letter that the send to everyone and you are already agreeing to give them some jack.

do not give these jerks any more money. make them sue, answer the suit (complaint) and most of all join the class action suit. i did and saved thousands.

It gained me time because I had already received the second letter. I have not given them any money yet. But it is obvious that they are going to go to the next step, which is suing me. I am part of the class action lawsuit, which I stated in my last post, and it was Mr. Wilens (the class action attorney) suggestion to settle. If I am sued it sure isn't going to be for $3500.00 but more like $10,000.00. I have not received a summons yet but know it's coming. I have also consulted w/ a local attorney and he agrees settling is a good idea. If anybody else has a good suggestion on another plan I'm all ears. Believe me I don't want to pay Dtv but at this time I have not heard a better option. I think the thing to remember is this is a civil suit and not a criminal suit. You cannot plead the 5th in a civil suit when they ask if you've ever stole satelite signal. If you don't mind commiting perjury in court by all means this would be the way to go but I don't think that is the smart thing to do. As stated earlier I'm all ears for suggestions but don't come back w/ wait until you get sued because I don't think that's a good option.

talk is cheap. And they are not the one looking down the wrong end of the gun.I have a buddy who going to pay up also.
His lawyer also told him it's the cheapest way to go. To fight it would cost him more then $3.5K and he might lose the case to boot.
BTW: It was the busted US dealer Dss-Pro aka Dss-Zone that give him up as an ex-customer. If you done business with them in the past. Your getting a letter.:gg

Of course its the cheapest way to go. It will cost you $5000 to have an attorney sit there going through all those depositions. They know this they are lawyers they know what it costs. Now if you are very clean meaning you bought 1 programmer and never used it, never bought anything else, and have evidence that you used it for legal purposes. You could fight it yourself. There are risk's involved you might need some assistance's from a attorney to help with motions. When Dave's attorney sees you are not using a lawyer they might try to file tricky motions. Federal court does have some legal help for people going at it them self's. Joining the class action as a named defendant can open you up to breach of contract if you sign there agreement. END user development are not attorneys they are a collection company formed inside of DirecTV. I think the reason DirecTV does not use their name directly for these letters is because they must have some fear of being sued for illegal business practice. In the chance they lost the class action they could just file bankruptcy for the end user group and this would not effect DirecTV directly. DirecTV could say we paid these companies to take care of this for us we did not have any direct control of them. You should get one more settelment offer letter right before you get a summons from local lawyers these will be the ones suing you. You can stall them for some time I was able to stall them for 5 months to settle. They will also do a 4 month payment plan.

You right on. That's what his lawyer told him. If your clean, an you purchase this item from "Dss-pro" For a legal purpose or you did not know this item could hack DTV. then fine lets go to he wall with this.But if you did know what this item was for and you did hack DTV then its best to say. "I no longer have that items. Sold it give it away whatever. Here's your $3.5K go away and leave me along please.
For us in the USA we knew what we was doing was illegal. And if we got caught we may have to pay the price. Well the price is $3500usd. Pay it and move on. He's still in the hobby but he will never buy anymore hardware.and when his loader no loger works he will be out of the hobby for ever. But after 3 months of sleepless nites he fell better now that this is behind him.

I got my summons I want to answer it I have a copy of "motion to dismiss", but don't have the "detailed discussion reguarding the above, please refer to the attached Memorandum of Law in Support of motion to Dismiss."

I really cannot believe the DRIBBLE I am reading here. PEOPLE WHO LOOK GUILTY BECAUSE THEY HAVE A LAWYER FROM THE FORUMS? REALLY!!!
What high school do you go to. Or perhaps what high school did you NOT go to. That is just about as INANE as it ever gets and I have never heard anything so stupid. Try to get this put off till you grow up a little.
And you want to file a motion to dismiss. Do you know you require a REASON to file such a motion. What is your reason and so you wont look guilty, get your milkman to do it for you. That otta work.
nbetl you seem happy for no other reason than you are gaining time to pay something you dont owe. Do you think you owe them $3500.00 because you purchased an unlooper. No, IF you owe them anything, its because you stole TV. You already wimped out and admitted you did that by asking for time to pay. And you are proud of the job you did on the phone. Give me a BREAK, you completely failed, admitted stealing and are PROBABLY SCREWED now. When you ask how much time you have to pay you are admitting guilt because people who are NOT guilty are not stupid enough to PAY.
I suspect that you are all guilty and so you are making the right decision to pay them. But if you are not guilty, I hope you are not going to pay for something you did not do. Even when they sue people, it rarely gets to where you actually testify in a court. Since they have no evidence about most people, they will rarely if ever go to court. So far out of 10,000 law suits, they have not yet had a single case decided in their favor by a court. Doesn't that tell you anything???
The only money they get is from those who confess to it and settle with them. Go ahead, do it, it will make you feel better for sure.
Or at least talk to someone with a bit of knowledge about the courts. Most of you here seem not to have the slightest clue. Maybe that is why you should hire a lawyer, so you get to have a little itsy bitsy knowledge about courts. Sorry guys but I dont believe I have even seen such a load of rubbish from people who are involved with a lawsuit, in my life. If I were them I would up the requests to $20,000.00 each and they would prolly get people asking for more time to pay :)
