OK, THE letter has been around for several months. It has come in several forms from several different lawyers or groups. What if anything has happened to the first batch of people who got THE letter?
What are some success stories in how to deal with this?
Is it worth it to complain to the FCC or am I setting myself up for something bigger?
Should I wait for a second letter before I have a lawyer contact them?
How many people have actually been brought to court for a single purchase?

Hi Elvisnh,
So far they have sent out about 20,000 letters to individuals but they announced that they would be sending over 100,000 in all.
Out of this they have received about 5,000 settlements and a couple of hundred people have lost by default judgement because they ignored them. They have filed several hundred suits but each suit includes from 7 to 20 people in it. Nobody has yet been to court and received a judgement one way or the other other than the defaults.

There has also been a class action lawsuit filed against DirecTV™ which can be seen at:

But bottom line is that they are serious and are taking people to court. Ignoring it does no good so it is something that should be dealt with one way or another.
I am surprized that you did not know about this since its been going on for at least 6 months or more. Have you been away?

No, haven't been away just thought I was going to be a lucky one that didn't get the letter. Now I have a lot of catching up to do!!

Had friend receive letter... He read all there was on the subject and hired an Attorney. Dave's lawyers sent his attorney a screen shot of a order from VT for an unlooper loaded with su2 sent to him a year and a half ago.... He decided not to fight it because of the cost (over $7,000 estamated) and he did not want his employer to find out about the lawsute... He paid the $3,500 + $450 in attorney fees... Called Dave and canceled his three legit subs ($72 per month). Dave wanted to know why, he told them about the extortion from their lawyers... They just said "Oh," he asked where to send his three HU cards. Dave said the cards belonged to him and he could throw them away if he wanted... So he reprogramed them and is watching TV...

WOW. He might want to read the agreement he signed when he settled for the $3500.00. If they come to check him or get a vacuum salesman to check (a private eye who can then get a warrant on probably cause) in there or read the signal from the street or whatever that will prove this, they will be entitled to BIG DAMAGES, the agreement will be cancelled and he can then be SUED CRIMINALLY and suffer a large civil damage.
Does this guy not understand that the courts are a serious matter and he can be held in contempt. All the releases (and there are a few) are posted on legal-rights but here is one of them as concerns this matter. Others may vary but are generally the same or WORSE.
6. Release by DIRECTV. In return for the consideration stated in paragraphs numbered 1, 2, 3, 4 and 5 of this Agreement, including the timely payment of all settlement funds in accordance with the Payment Schedule, DIRECTV hereby fully releases and forever discharges Released Party from any and all civil claims, demands, injuries and causes of action, for damages or any other relief, in law or in equity, based on claims arising out of, or related to the facts of, the Dispute. The Parties agree and understand that this Release DOES NOT INCLUDE any release of obligations under this Agreement or, (1) claims of DIRECTV that are based upon conduct of Released Party that occurs after the date of the Agreement; (2) claims of D1RECTV that are based upon Released Party‚s failure to pay DIRECTY pursuant to any subscription agreements he/she has with DIRECTV; (3) Released Party‚s use of Unauthorized Devices for commercial purposes or private financial gain; and (4) claims from persons or entities other than DIRECTV, specifically including prosecution for violation of criminal law. This Paragraph 6 of the Agreement does not release or discharge any obligation created by this Agreement.
10. Breach. In the event that a Party fails to promptly satisfy the terms of this Agreement, the non-breaching Party shall have the right to bring suit upon this Agreement and shall recover pre-judgment interest at the maximum rate of interest permitted by applicable law, and attorney‘s fees and costs associated with the suit or any subsequent appeals thereof. Additionally, in the event DIRECTV proves a violation of paragraph 1, 4 or 5 of this Agreement, DIRECTV‘s release provided in paragraph 6 of this Agreement is voidable at the sole discretion of DIRECTV, thereby allowing DIIRECTV to pursue claims against Released Party arising out of actions released by paragraph 6 of this Agreement. The remedy provided in this paragraph is not intended to be a sole remedy or to in any way limit a Party‚s right to seek any type of redress, claim or damages available under the law or at equity.
I have to tell you sir that your friend is a TOTAL MORON because DirecTV™ does do checkups on this and if he is decoding TV they WILL catch him and the result of that wont be funny. He might just visit Bubba too so tell him to get a jar of KY jelly ready too.
I don't mean to be disrespectful ( I KNOW its not YOU) but this is as DUMB as it gets and I guess the $3500 plus costs did not teach him a thing. The FIRST time he might just have won in court but now that he has signed his rights away HE CANNOT WIN ANYTHING.
I don't think you would find another person in 20,000 who would do this. If you are a FRIEND you may want to advise him to STOP while he can. If I settle I will still hack. ---- them. Call me a dumbass all you want but I refuse to let dtv win in any way. People act like they are smart and do all this detective work but they have done none so far. They took shipping records and sent out form letters. IF drove by everones houses they would probably know right away who to sue. This tells me they are not spying one people yet. IF they force say 30,000 people to settle that would be a hard thing to follow up on. People move around etc. Would cost them alot of money.
