nothing illegal about it at all, as long as its blank (most electronic parts houses such as mouser sell them blank anyway)
Even buying an ISO programmer isnt illegal in inself, my windows XP at work requires logging on with a smart card in one...

Of course there is no law against you buying an atmel chip. Just as there is no law against you buying hydroponic growing equipment. But if that purchase also comes with the huge rise in your hydro bill and investigation shows that your house is giving off large amounts of CO2. Also if you have been known to associate with pot users. You may well find some very inquiring types wanting to search your place.
The atmel chip is 100% legal and is quite common. Even the hardware to program it is common. But if they can prove that you have been hanging out in DTV hacking sites and have downloaded the file necessary to do the cards. Then how hard would you expect it to be to come and get you with a search warrant.
We know that DTV monitors these sites 24/7 and yes they will record all those who come and go here. Now along with this they will also track every site that has files available, and record who downloads them. Since this is the day and age of computers, it is not a big deal to cross reference these things. Now lets take this even a step further and say you have a problem programming your card and come and ask a question about why you get this or that message..... Does this not sound like a confession.
It is not so simple a thing as whether an atmel is legal to buy. It has more to do with what purpose you put it to and whether others can track those actions back to you or not.
