I got my first letter about two weeks ago. My lawyer says it seems like they are not willing to negotiate for a settlement. Part of me wants to settle so I don't have to worry about this anymore and part of me wants to ride it out. After all, how good is their info since my last name was spelled wrong and the house number was wrong on the letter head. My question is for anyone that has settled for less than the outrageous $3500 End User Group is demanding. Has everyone that paid, paid the full amount? Any help is appreciated.

Also my lawyer didn't make a big fuss about my info being wrong on the letter head. Any one with legal knowledge on this is helpful too! Maybe I need a different lawyer.

Basically My opinion is, Is that you should seek another lawyer. The one you have sounds like he isn't trying and that he doesnt want to represent you too well. I have a few friends that have gotten the letter and their lawyer laughs at it and says "Dont sweat it, all will be taken care of and that you (ie, the friends of mine) will not have a thing to worry about. This is just my opinion tho, on what you should do.

Can you send me a copy of the letter? Let me take a look at it and I will see what I can find out for you. It seems like to me they will have a hard time proving what you used the equipment for. There are so many uses for having a smart card programmer and none of them are illegal. Possession of a programmer is not illegal. You can cross out any personal information you want. I've read most of the threads concerning the Dave's letter. My question “why retain the services of an Attorney before you get your summons?” Some people live pay check to pay check and are unable to pay the retainers. I used to worked in Law Enforcement for 8 years, basically these are accusations that leave Dave’s butt flapping in the wind and open for counter when he is unable to prove wrong doings. Can Dave afford to lose even 1 case with the SBC discussion in progress????

Retainer fee avg for this situation should be around 5 to 8 hrs. This is so that you don't skip town and not pay your legal fee.
