This whole issue comes down to the “lock box” paradox. I think that
everyone would agree that News Papers have a right to recover distribution costs utilizing a “Lock Box”, but that the Government does not have a right to regulate that ALL News Papers must use a “lock box”.

The Satellite distribution regulators (FCC) have allowed “Lock boxes” to be placed on programming intended for the general public. We could agree that dave has a right to recover the costs of distribution but what are his costs?, or why is public programming not carried in the clear.

The NFL is “the” prime property of Commercially sponsored broadcasters. Networks can be launched/born (Fox) by obtaining the broadcast rights to sports. It is not just a coincidence that successful marketing of subscription (lock box) services are dependant on Network production of commercially sponsored sports.

The US Satellite distribution costs, of Network programming, are an example of gouging the public. Bell Canada Satellite services provide the US networks for $C 5.95 ($3.75 US) and this service includes NFL (east and west) with a foot print that covers
continental USA. I don’t think the Canadian CRTC know the value of that package or its competitive significance to US broadcasting.

Civil disobedience to this type of predatory marketing, by dave, is justified.
