Only entrapment if you have no choice but to buy it from them. You have a choice here.

I don't think so. It would be entrapment if you are somehow forced to participate but if you do it of your own free will it isn't. Look how they get people for soliciting prostitution. An undercover female agent disguise as a prostitute and any Joe that solicits her services is busted. I could be wrong though. I’m no legal expert.

Yes but if it was a sting they would mention that it is for Directv, otherwise you just claim that "Hey I thought I was buying a receiver for Bell" How could they prove otherwise?

More likely some stupid individual put in charge of auctioning off seized merchandise does not know that its now considered contraband in Canada.
One might think that this would be a newsworthy thing.
Cops bust dss dealers and seize merchandise and later sell it out the back door

I have as much fun with the politics of this game as anything.. that link just cracks me up!
Their excuses will be 3 miles deep as to “how” that got listed.
I wonder what happened to all the good receivers in “inventory” ?

en·trap v. -trapped, -trapping, -traps 1 to attract into difficulty or trick into harm: A criminal entrapped an elderly man in a bad investment and stole his money. 2 to catch as in a trap: Workers were entrapped when the roof fell in on them. -n. [C;U] entrapment.
I can't find any of my law books at the time but under canadian law the authorities cannot arrest or charge somebody for something they sold to you. Whether it be drugs, tickets or anything. They could however take a list of people they sold to and get a search warrant for the satellite card which it needs to work.

Well, I had to go look...That is funny, kinda makes you think they hit a stereo shop up there and now getting rid of the booty...hehe
Your right on the crooks part...very bad feedback...seems that they used the same courier as MJ did...(two threelegged dogs and a 300lb. courier)
Just had to throw that one in...:gg

In Canada before you can even claim entrapment you have to be found guilty or plead guilty, then the issue of entrapment is dealt with, so it is a risky proposition.
I highly doubt this is any sort of setup as the Metro police do not even deal with Federal enforcement, which falls on the RCM(tv)P. This is just a case of them not knowing exactly what they have, and underscores just how preposterous the law is, that a device which appears legal to any layman (or police officer for that matter) is actually illegal because of what you might watch on TV.
It certainly could make for a good defence, if I were still in business I would buy that receiver and keep it in inventory, then should the RCM(tv)P pull their stunts, they would be a little surprised that it came from the TO Police.

yeah, it's an oversight i bet. The TO police prob even contract out the listing and selling of the equip for them.

well dean i am sure you still have contacts... if you would send them an email and ask then to buy them... this could put a twist in things...
make sure they get receipts etc.. .
and as far as the prostitution thing goes and entrapment etc... in those circumstances you are not under the impression that they are cops they are dressed and disguised as drug dealers or prostitutes... in this case they are representing themselves as police and you have the right to assume they are acting in a legal manner.

I think the guys @ incredible should be bidding on this one.
They can raffle it off at the next Charter Challenge fund raiser...

Well...If the police are selling the units then this ALL must be legal RIGHT? This is one major "F" up of a mess if you ask me.

What proof is there that this is in fact Metro Toronto's finest? Just because someone uses what appears to be a legit user name and inserts a few authentic looking graphics into the auction doesn't mean it's the real deal.
Perhaps I'm not as eBay savvy as some of you, but I'm not buying this (or the items up for sale) for one second.

Okay, so now the auction is closed?!
I guess the local Tim Horton's is being held up. ;)

According to what I found on Ebay, the bidding was supposed to remain open until the 24th and the top bid was $255. Is there anything in the Toronto papers this morning?

I made a bid on 12 DSS H cards from the Canadian Government assets website. I put in a very high bid and was successful. I pick them up from one of their distribution locations.
They came from Canada Customs at Windsor and has the sender and receiver name.
But the sad news is that nothing will happen. The first time CBC testified that they were taking clips of sports from DTV and redistributing on their network. The first time CBC testified that they were taking clips from DTV and rebroadcasting them. They were my customer since 1996 and paid with their Corporate Credit Card. RDS testified to the same thing.
What happened ? nothing..

be carefull of purchases on ebay. watched screensavers lastnight and they reported that your personal information and what you purchase etc. can be given freely to the police with just a fax requesting it.
