My lawyer had a question I said I'd research for him. There is
more than one dish provider out there. What prevents Charlie
from suing next? I guess if you bought an access card he
couldn't but what about an unlooper? Doesn't the same
equipment work for both in some cases...or do you need to
have a device with switchable crystals, etc.? I cannot
find a detailed thread about the specific technology.

Actually Charlie has been litigating against end users as well, just on a much smaller scale and they are going after people that are more likely to be small time dealers and seem to be more picky about who they go after.

DTV has discovered that suing people is more profittable than supplying them with legit services so they are going after 10's of thousands of people using a big call center group called the end users group.

Charlie is more wise and sitting back and watching to see if DTV get bit back for their actions.

The only reason that I can think of for why Dish hasn't started their own letter campaign would be business ethics.......Common sense tells you that suing current and potential customers in Federal District Court with next to nothing for evidence probably isn't the best way to stay in business. Word of mouth is still the best advertising, after all. I don't know of anyone that has received a letter that had anything positive to say about DirecTV.

I could be wrong, though.:Z

Correct me if I'm wrong, but isn't there such
things as "Dave programmers" and "Charlie Programmers"
and the two aren't switchable? If there is a settlement
to Dave that seems to mean there is easy path ahead.

I totally agree, those thousands of people who got the letter and settled will most likely subscribe to Dish, and the ones that were subscribed to dave will switch to dish, so dave will lose in the long run. Dave if making people to hate them as well as loosing thousands of potential customers that are now subscribing to dish.

I can see it now, the "charlie" defense.
Claim the device was bought to hack dish not dtv and see if they let you go!

My lawyer was worried about future liability
and how to write a disclaimer. My question
boils down to: "does Dave equipment even work
with Charlie?" The only answer I got is:

YES!! there are many devices that can be used in some fashion with both systems. There are a few multi frequency programmers ie. SD Logic for one. There is an atmel flash for converting a Loader/unlooper into a device to use with "charlie" cards. Some units, though not intended to work with "charlie" will still do the job, ie.The Litronic Netsignia 210. SO I believe you lawyer is right to consider the possibility of future litigation from Charlie over any devices purchased to work with Dave.

Where can I read about the differences?
For instance, if this Atmel Flash is
somewhat new, an older device "became"
potentially damaging to Charlie. I am
trying to advise a kid who still claims
he does not have an Unlooper. If he
turned it in it might limit his liability,
on the other hand it might be a criminal
admission.

with all respect, I just got this response in a Charlie forum:

"The old 3in1's will not work for dish. They are programmable for a phoenix style programmer but will not work for dish. You can flash the unlooper and play around with echoloader but your playing with fire and are very limited. It only works on rom2 and 3 cards and only loads bin files. You can edit IRD and boxkeys and what not but you cannot edit in EEPROM. You must edit in eeprom in another program then load the modded bin file to card. Your better off buying a generic dish programmer."

Maybe Charlie would have a very limited case, too?
