I have read almost every post on this subject and dont believe this has been asked.
Has anyone that has bought something and did something they can be traced to... But HAVE NOT received a letter or summons thought about having an attorney simply contact Dave now and ask if they would settle for a lesser version of their current settlement agreement. Because their client is simply scared and knows they have done wrong and simply wants to put this behind them instead of watching their mailbox and driveway everyday for the next two to three years.
I worry that some people will get sick literally because of the stress of worrying if they will be next......
I am not advocating this just simply curious if it has been done... If so to what account?

Not gonna flame here just going to assume a mental patient got loose in a psychiatric institution somewhere and somehow got access to a computer.

I know I might not be as well spoken as may be needed in this. But please think about it logically before condemming the possibility. I will bet right now there are twenty thousand people worried to death they will eventually get the letter. Or the summons. I guarantee you that out of all of the people that are sitting and waiting that at least ten will die due to stress aggrevating an already suffering heart condition. (From sitting around watching to much Tv and eating chips...grin)
I remember as a yound child doing something wrong occasionaly. The wait was worse than the punishment. Especially if my deeds had not been found out yet.
I appreciate your self control. For not providing flame to my comments, I say thanks. But for those out there that are tired of awaiting their doom I think there is some merrit in getting it over with............ I wouldnt even consider it without getting a paid professional opinion.
But I also sometimes subscribe to: The un-official policemans creed as I remember it from years ago. It has merrit as well.

One last point / question... Is there any real threat to Dave now from anyone that bought a smart card programmer? I was under the impression that the cards that are being used currently need a loader / unlooper type device of some sort? If this is true how would anyone with a single purchase of a smart card programmer years ago be of any threat for future alledged theft.....

Maybe the famalies of the ten can sue DTV for cause of death for excess waiting period.

No one can tell anyone else, what to do.
Each persons circumstances are different.
HOWEVER, if you openly admit guilt, you leave yourself open to other posssibilities.
(I.E.) Civill and criminal prosecution proceedings.
Problem I see is this----------> I have not seen one person who has settled, get anything in writting that DTV, or any of their affiliates will proceed with any further prosecution attemps.:eek:
So,, the door is still open.

Yeah I must say that I've had those thoughts that you speak of. My issue is as follows....
I consider myself a typical enduser. What ever that implies...I was a member of DCN Platinum. So I know I am going to get a letter someday. My concern is this...Won't it be better to get one now at 3500 bucks versus a year from now when its up to five or six G's. Keep in my that the settlement was only a couple grand a only year ago. Damn that dave - you'd think he'd realize what our nations economy is doing and keep his inflationary demands to a minimum. So yeah, I think it'd be nice to bow out now at 3.5 K vs tomorrow at much more. But the last thing I am going to do is call and plead dave to send his letter. Who knows, maybe I'll get lucky and they lose my name & addy.

Just invest the $3500 and in a couple years if you get the letter, you will be able to cover the "inflation" that Dave puts on the bill.

Hey I know, I'll invest 3500 bucks in a new P4 fix and loader and charge all my friends 100 bucks a pop to fix cards. That way I might even come out on top in the end....

Seriously folks, Just trying to show sdfghjkl that others have same concerns & think proactively of what they would do "IF" they get "the letter" Anyone that says they have never thought about it is just lying because this is the risk of this hobby. One mustn't play if one cant pay. Nothing to jump off a cliff over. And I'm not. Just kicking thoughts around with a few buddy's...so flame away if it makes you feel good. But beware, the mail man is lurking....HA HA HA HA....

I am not sure what you are saying, but the release agreements I have seen are full releases for any activity done prior to the release date. That does not release the Released Party from any claims based upon conduct of the Released Party that occurs after the date of the Agreement. So, as long as a person does not continue to pirate DTV's signal, there should be no more issues with DTV.
Also, the agreements posted on the web state that DTV will not initiate criminal investigations related to theft of signal, subject to the terms of the agreement.

I would not bet on that... We are not at the point where numerous individuals have court dates set and are represented by good legal council. It is very possible that we are going to find the courts taking a dim view of DTV's tactics and lack of evidence. Not to mention thier attempts to sue for statutory damages based on a criminal code that they can not prove was violated.
The people that are fighting this would have been better off from a dollar perspective to have just settled. But the soldiers that died to protect our freedoms would have been better off just being draft dodgers too.
I think I would hunker down and wait a bit.

Havent ever posted here.. but been a reader for years..
anyway.. i got the "letter" and subsequent fake "summons"
about 20 months ago.. I attempted to settle numerous
times without the aid of an attorney. Without going into
details let me say that they would not budge from their
offer of $3500 no matter what. My last communication with
them was a few months ago. Im awaiting my summons. Im sure
its just a matter of time. Let me say that it did cause
some serious stress in both myself and my wife (unfortunately).
Its been so long since the initial letter that part of me
is even looking forward to it. I fully intend to go it without
the aid of an attorney. I did not do anything illegal.
I just cannot believe that they can win any form of
judgement without proof of something....after all.. this is still
America... isnt it???
The way I see it is that there are four possibilities..
No Lawyer and settle...up to $-3500
Lawyer and lose... up to $-13000 (10k + 3k for the losing lawyer)
Lawyer and win.. minimum $-2000
No lawyer and win.. $0
So.. if I use a lawyer I am guaranteed to lose money.
I would rather bet it on the longshot rather than
throw it out the window.

Everyones experiences will be unique. Beefy did not have a beneficial one in his eyes, others have. I agree with Rissler, this hobby is at a crossroads right now. The murky waters will become clearer as time moves on. If Dave begins to win case after case, by all means settling will be better, but by that time the amount will be higher perhaps and he will not negotiate. If Dave begins to lose frequently, then fighting becomes a much better option and the letter campaign will die or be forced to mutate rapidly. For all the soles currently being sued, they are the all important infantry in this war (old style WW I type war, not current high tech war). If our guys can advance battle lines with wins, we all stand to benefit from their battles. If they lose the converse is true. I think all of us who aren't being sued should feel lucky we get to be spectators in this boxing match and we should all support David (hate to use a "Dave" for us but you understand the analogy) and heckle and "boo" Goliath. When the smoke clears, we will all have a better perspective on how we should proceed with the letters and how and if this hobby will be affected and if it survives and how our 1st amendment rights will be obtunded or protected. This is a very momentus time---a critical juncture for this hobby.
