Well, I just received my summons. Contacted a lawyer and he said he'd represent me throughout the entire case for $2500.00 and would even refund a portion of that if Dave dropped the case. My question is, what exactly does the Fulfillment Plus records does Dave have? Is all the information from a hard drive or does he have hard copies with signatures?

I would also like to know EXACTLY what records were kept at fullfilment plus. It appears it is not CC info because the summons states interstate or foreign wire or something like that. So, in actuallity they really do not have that info. So, if a person orders from vector tech, vector tech then sends their money to fullfilment plus, and the addresses to ship to and what the person odered. So, if they have your CC info then they would of had to raid vector tech's record to get that info. Did anyone actually think about that. Think about it, what would vector tech forward all the information directly to fullfilment plus just to place and order without making money for themselves. So that would be my GUESS, but I could be wrong. Also, do not forget about the little insert, "upon information and belief". They does not really say much, and covers their butts because they say the believe that someone is doing something. MY .02 for the morning....

When Fullfilment Plus shipped the products, did they require signatures when the packages arrived, does Dave have UPS or FEDEX signatures?

From Fla, when we got our first letter I called them and they said we purchased some items from DSS Pro and it was charged to our AMEX card,if you have read my previous post you will see we did not get the equipment and AMEX issued us a credit. So, I told them if you have a copy of the charge then you must have a copy of the credit, they said no. Come on, I even sent them copies of everything and they just issued a summons to my husband, which by the way they have 120 days to serve it and in Fla they have alot of people to serve and are not hiring any more servers, atleast what a lawyer I contacted said. Also, you can have on file that FEDEX leave a package with no signature even if the sender requires it. Another interesting note: Our AMEX card shows we purchased from SmartCardSolutions but DTV shows it was DSSPro, maybe SCS was a division of DSSPro, I have no idea. I also requested from DTV a copy of my payment records dating back to 1997, it show where we purchased PayPerView and were paying extra for other channels. So go figure.

If what you say is true, they will cave, but past performance is an indicator of future results, they may wait you out all the to the trial date.

That what the lawyer in Miami said. But we are going to try it until the very end and then if we have to hire him we will. He said it to go ahead and try. So once we get the summons we will present all of our paperwork. Really sucks when you are really innocent. I remember my complaining at the time (when he did not receive the equipment) But I guess there was a reason we didn't. Also, is there a fund that we can contribute to fight them? I saw something about PayPal in a message but didn't know what it was for. Thanks

$2500 sounds like a great deal to fight DTV. My attorney said It would cost $10,000 to fight them. Sounds like either you have a really nice attorney, or he charges a lot less. DTV will cave in, or try to run your legal bills as high as you can go. They hope you will settle, but if attorneys are offering $2500 flat rate to fight them it will be hard to settle for $4500 or more. I wish more attorneys could pull together, and lower their rates to fight them this would help a bunch.
