lol you guys are all the same quick to
start declareing fact.
you dont have a friggin clue as to how
many suits have been filed.

This is a direct cut and paste from a Pacer web search. Anyone who follows our pacer report at http://forums.wumarkus.com/viewforum.php?f=8 knows that there are duplicate entries from time to time which would bring the number down at least 300. You can also take out about 100 cases that are not enduser related due to DTV contracts and such. Without going into each case it is safe to say DTV have filed 3700 cases against end users give or take a 10-20. After doing a cross sampling of over 400 cases in 20 states the average number of defendents per suit is 3, excluding John Does since we all know DTV cannot sue Bugs Bunny or the Pink Panther.....as many of the packing slips they have are sent to them or some other fictional caracter.

Doing the Math there have been approximatly 11,000-11,500 people sued. Without spending $1000 in pacer fees this is probably the most accurate number available today. DTV by their own admission has sent 100,000 letters from the may 2001 busts. They have also sent out additional letters from the Shanty, KAC and other busts that have taken place. The exact number is impossible to calculate but it is well over 100,000.

So, Is it safe to say everyone who received letters will be sued......absolutly not. With The SOL expiring on the meat of DTV case by their own admission on the may 2001 busts is it safe to say that 11-12% of the people who received letters got sued....I would say yes. Granted some settled before they were sued and since they have non disclosure agreements in place the number of them will always be unknown. I will however guarantee to you that it was not 89,000 people.


Pacer does not lie and the numbers are public record. I would suggest you open your account today if you want to argue numbers.

Ah, Pacer what a wondeful tool. That is unless prefer to use bogus numbers and pass them off as fact. I wonder how long before this thread gets closed.

lets see first with you guys it was 10 to 15 or
5 to 15 per suit. then it was 8500 suits. then
it became 8500 people. then it changed to 1 to 3.
you put the chances at 5% of being sued then it
was 8 to 9%. some of you had it at 50%. so todays
number is 11 to 12%

but dtv knows for sure.
another round of letters and or suits are on the
way. the dont worry be happy crowd wont be able
to do the damage they did last time.

He never said getting a lawyer at that point was bad.

Atleast talking to one is a good idea. I would not pay some lawyer couple grand to work out a settlement with D##.

You ya head and be prepared. Dont go blow off ya money.

Ok lets stop all this garbage,it is starting to get personal AGAIN.
If you want to post PACER that's fine and indeed may be helpful to some. You want to keep calling out people for a confrontation then that is against the rules HERE when it become personal in nature.
You can do what you want at your own site but HERE we have rules.

I believe the 100,000 letter figure is also in dispute. If memory serves me correctly, at one time a spokesperson for dave threw that 100 grand number out. When the number was used as ammo in the countersuit to show how prolific the letter campaign was, dave disputed that the number was inaccurate, implying it was high. So the percentage of those being sued may be higher.

We may be able to get at the numerator, using pacer, to show the number of suits. But only dave knows the denominator, the number of letters.

This would be so much easier if we could post in crayon for some people.

For the last time. IT DOES NOT MATTER IF YOU RETAIN A LAWYER OR NOT AT THE LETTER STAGE. IF DTV WANTS TO PURSUE YOU THEY WILL. I DON'T CARE IF YOUR ATTORNEY THREATENS THEIR LIFE, IT DOES NOT MATTER.

If you want to settle at the letter stage, get a lawyer or do it yourself and hire an attorney to look over it.

If you want to fight, wait for your summons and retain an attorney or do it yourself if you don't have the money. It's not rocket science. I never will understand some people. Step off of you grandstand and quit patting yourself on the back. You havn't doen anything worth bragging about, except some giving wrong information.

I couldn't disagree with you more, Patrick Henry. If you follow that advice you'd be giving up "attorney shopping" time, for one. When these suits go out in big batches, you can count on the lawyers experienced with these dave letters (on legal-rights.org) to be absolutely swamped. What's the harm in being prepared? On the other hand there's plenty of harm for not being prepared.
