This is a direct cut and paste from a Pacer web search. Anyone who follows our pacer report at http://forums.wumarkus.com/viewforum.php?f=8 knows that there are duplicate entries from time to time which would bring the number down at least 300. You can also take out about 100 cases that are not enduser related due to DTV contracts and such. Without going into each case it is safe to say DTV have filed 3700 cases against end users give or take a 10-20. After doing a cross sampling of over 400 cases in 20 states the average number of defendents per suit is 3, excluding John Does since we all know DTV cannot sue Bugs Bunny or the Pink Panther.....as many of the packing slips they have are sent to them or some other fictional caracter.
Doing the Math there have been approximatly 11,000-11,500 people sued. Without spending $1000 in pacer fees this is probably the most accurate number available today. DTV by their own admission has sent 100,000 letters from the may 2001 busts. They have also sent out additional letters from the Shanty, KAC and other busts that have taken place. The exact number is impossible to calculate but it is well over 100,000.
So, Is it safe to say everyone who received letters will be sued......absolutly not. With The SOL expiring on the meat of DTV case by their own admission on the may 2001 busts is it safe to say that 11-12% of the people who received letters got sued....I would say yes. Granted some settled before they were sued and since they have non disclosure agreements in place the number of them will always be unknown. I will however guarantee to you that it was not 89,000 people.
Pacer does not lie and the numbers are public record. I would suggest you open your account today if you want to argue numbers.
