The author the way I read it says 9(1)(c) infinges on section 2b on freedom of expression to Canadians who pay a fee to access US signals but doesn't pass the test on infingement on 2b on Canadians who access US signals for free..

Hi GS2,
In the conclusion it calls on parliament to change the law to bring it into conformity with both the grey and the black markets on Page 115.
This is in fact correct as the law does not comply with the requirements of either the way it stands now.
This was written by a gentleman described on page 116 who even gives a contact. Email address for himself. I would like to get a full sized copy that is clear and readable since a lot of this can be used directly as not only is the paper well written but it is also clear as to the authorities it uses to justify this position. This says exactly what we have all long believed is the correct interpretation and that the government is required to CHANGE THE LAW to make viewing without paying illegal and it does not seem to claim that they can stop those who pay for the signal from receiving it, if the charter is to be respected. At least that is the way I read the document.

Yes I read that but as it stands until the law is changed if ever the author put his test of 3 requirements for 2b charter infingement on US companies not licensed by the CRTC and concluded that paying for it passed the test he used and not paying for did not pass his test.
He is only one person who has his view and opinions while many others might conclude otherwize like the comment by the judge in the R.E. case in Sask. As long as we have the Liberals catering to Bev I don't think they ( Parliment ) with change anything if they win on the Charter. If they lose they may change it and make it worse then before. They don't seem to care about Canadians versus big donations from companies.
