Hi Dean,

I have two questions that I hope you wont mind answering for me.

(1) Do you have a date when the judge will release the ruling you are expecting from 2-1/2 to 3 years ago? Obviously6 that’s out best hope for a Charter ruling at this point and naturally we are all pretty anxious to see what he will do.

(2) What ever happened to your case with DTV in Michigan where I was supposedly ratting on you because my name appeared on the witness list apparently. Its been quite some time now and you were to post what that was all about. Obviously they KNEW I would not be attending anything in the USA so it was obviously some type of Bluff. But I don’t quite understand it. Has the case come up and if so were the witness they had listed (not only me) ever appear. Did ANY of them actually appear.

To me the whole thing was quite the sick joke but I am hoping you now have further info on it.

well actually that case is from 1997 (6 years ago) and we have been promised a "mid-september" or shortly thereafter ruling...

As to the Michigan matter, your name being on the witness list (which it was) must have been a sick joke as it has never been brought up again...

Well that only goes to show all of us that DTV and NDS, will try just about anything to cause decension in our ranks. Now that we can see their tactics with this proof, let us all remember them for next time.

Also Dean, it sounds great that the ruling is coming that soon. the only better news would have been "you got it and we won on the charter issue". Now lets hope that is a proper prediction of the ruling when it does come. We will all have to wait for it. After six years, whats a couple more weeks :)

If he acquits him under the CC which is possible and even probable due to past rulings, then he wont make a charter ruling on that.

But under the RCA he MUST CONVICT (due to the SCR ruling last year and then we have a very good chance of him winning under the charter which I think might . Ian Angus was here yesterday and the thought it was most probable that he would get it.

Whitch law was this case under Dean, CC or RCA or Both? If it is under both he could STRIKE the RCA and then acquit under the CC as there has ben no Ruling other than wins under that and its not affected by the SCR ruling as that was strictly RCA.http://www.legal-rights.org/images/ttrk.gif

If he did strike under the CC he could only strike 327 but if he strikes under the RCA, I am not sure if he would strike the whole act or just the parts pertaining to theft. Be interesting to know.

...we were never even charged under the CC, if we had been we would have used that as further ammo in attacking the unlawful seizure (without a search warrant) ie even if a warrant had been obtained, it was a seizure for an offence that doesn't exist.
