View Full Version : Told to shut down my File Section!

I know you guys deal mainly with Canadian Issues but I thought I would write you about my problems here in the USA. My ISP received a letter from a law firm representing DTV and was told that my activities on my website were in violation of Federal law and that they should direct me to voluntarily shut down my File Download Section or they would file law suits against myself and my ISP. I don't know if I should post my URL because Muggles gets very upset. I discussed this with my attorney and he said that after a long costly court battle I would probably win but I would be Bankrupt.
I'm a retired cop and live on a pension that basiclly pays the bills. I love this hobby and I enjoy helping people but not to the point of losing everything. I know you folks know a lot about Canadian Law but I was wondering if you have delt with this situation in the USA? I would appreciate any comments (positive or negative).

I would say better to find a CDN host to put your files. Check with Rise or DR7 and see who is up here that will do it.
I would have to agree that you would have to spent alot of money to fight just leaving files.
I went to your website and checked you sell ISO programmers so posting the URL would be a problem. PM muggles and get his opinion.

In the USA you would be fighting an uphill battle the whole way. Normally I encourage people not to go gentle into that good night, but freedom of speech has its limits when it comes to "aiding and abetting" a criminal activity which is what posting 3M software files amounts to. Comply with the request and place the offending material with an out of the country isp. Provide a link to the files from your site.

I have (2) brothers who are attorneys, and (1) who is a sheriff. The reason I do not have files on my website, is because I was guaranteed by them there is NO WAY to beat DTV and their attorneys.
Not with the backing they have. So, do as suggested. Find an ISP in Canada.
As for your Pissing me off. I do not take what happens here personally. But I will tell you to get a banner advertisement. Or, do not place a url to your site that has advertising on it.

I thank all of you for the advice. First, I will try and find an offshore ISP for my files. Second, Muggles, I am going to do the necessary alterations on my site to conform to your policies.
Again, Thanks to everyone. I don't plan on bumping heads with the big boys but I will find and use every high or low road around them.
