Hi Everyone,
Well I have more good news, not unexpected. Today the judge came out with a positive ruling in the Roy Levine case where WIC tried to get an injunction against him in the FEDERAL COURT in Winnipeg. While I will not have a copy of the ruling until tomorrow (which I will post on the http://www.legal-rights.org site) here is essentially the gist of the ruling.
Injunctions look primarily at three issues in Canada.
(1) Is there a “Prime facie“ case?
(2) Is there “IRREPARABLE HARM“ DONE?
(3)To WHOM is the “Balance of Convenience“ if the injunction is issued.
Well the Judge (in the FEDERAL COURT of Canada, the same court as the Mr. Justice Gibson Norsat II ruling) ruled that (1) No there is NO prime facie case; (2) There is NO irreparable harm done to WIC and (3) No the Balance of Convenience should not be with WIC and effectively it is Roy Levine who would be damaged and harmed if the injunction were issued.
SO NO INJUNCTION at ALL :)
The Judge also made it CLEAR that “the WIC SIGNAL“ is NOT being decoded in this case and THAT is what would be protected against in Canadian Law.
I will have a full report tomorrow but this is simply one more NAIL in the COFFIN of the Canadian Government and the RCMP’s outrageous stance in these issues. More an more courts are ruling on this and these rulings are coming down on the side of RIGHT and are PROPERLY adjudicated.
CONGRATULATIONS ROY LEVINE!!! You deserve this hard fought win and you went well beyond the pale in fighting for your rights and the rights of ALL CANADIANS. We are all gratefull to have had you fight this battle as you proved by yourself to be capable of BEATING GIANT CORPORATE CANADA and you sir should be VERY PROUD. The battle was LONG, HARD and COSTLY but you WON and the results are WORTH IT.
