Talking WINS, we have ANOTHER BIG ONE apart from ROY LEVIN.

Last week a judge in Northern Ontario ruled on the INTERPRETATION of the ACT. I have only a sketchy report so I prefer not to say too much until I get the RULING. The lawyer will send it ASAP as I can submit it in my case before the 25 Aug, 2000.(It is being obtained on an expeditious basis).

Apparently its a very STRONG ruling like Mr. Justice Haliburton (In LeBlanc’s case :) and Mr. Justice Klebuc in Saskatchewan.

But its better because the eastern (read Quebec and Ontario) courts don’t see ONTARIO like Sask. or Nova Scotia (that is to say somewhat like Angola in deepest Africa) and they consider these mainstream in Canada. That’s a STUPID stance as N.S. and Sask. are Canada and the law is FEDERAL but you cant account for idiocy on our Governments part.

But it is a VERY BIG WIN!!

Wow!!! That sounds GREAT.. haven't heard about it..

Hi Everyone,

Here is an excerpt from a legal document filed in my case in the court in Valleyfield today.

“Earlier this week, Justice Diane Baeg of the Ontario Court of Justice sitting in Thunder Bay, rendered judgment in the case of R. v. Krazy Krazy Audio Video Experts, Pereira & Lamers (97-730). Although we have, as yet, not obtained a copy, we believe that this judgment, concerning interpretation of the Radiocommunication Act, is relevant to the present case. “

The intention HERE is to have my judge call the Ontario Judge and get the information on the ruling. Otherwise he may be required to WAIT for a copy which could add delay.

Essentially this ruling acquitted the defendant (s) and is very much along the lines of the Erieser (J. Klebuc) and the Leblanc ruling (J. Haliburton) rulings BOTH of which were VERY heavily for us and DID NOT follow the Knibb ruling.

This ruling should provide VALUABLE Guidance for Judges across Canada because it is an Ontario court ruling, highly considered. ALL Judges in all undecided cases who are advised of it MUST consider it in their rulings. There are 4 or 5 cases in Quebec alone apart from the BC ruling and others in Ontario where THIS ruling will go STRONGLY to our benefit.

Things are getting BETTER and BETTER by the DAY.

Congratulations Krazy Krazy. Looks to ME like you ain’t so Krazy after all :)
