Well given the recent decisions, I decided the RCMP ought to really change the content of their webpage.

So, today I emailed them:

Gentlemen:

On your webpage you have a 'consumer warning' posted, url:
http://www.rcmp-grc.gc.ca/html/satellite-e.htm

Within that 'warning' are contained assertions of certain activities alleged to be illegal.

There are now 5 Jurisdictions in Canada where the Radiocommunications Act has been interpreted by Superior or lower Courts contrary to that interpretation which you are putting forth on your web page.

One of those Superior Courts was recently upheld by the British Columbia Court of Appeal, the decision can be found at http://www.courts.gov.bc.ca/jdb-txt/ca/00/04/c00-0493.htm

Given the irrepairable harm that is being done to those who are involved in selling foreign DTH systems in Canada by your incorrect assertion of the RadioCommunications Act, I kindly request that you either:

1) completely remove the offending page(s)
or;

2) update the information contained on the offending page(s) to reflect the proper interpretations that have been applied in British Columbia, Saskatchewan, Nova Scota, Manitoba and Ontario.
or;

3) prevent persons who are using ISP services in British Columbia, Saskatchewan, Nova Scotia, Manitoba and Ontario from accessing the offending page(s).

Further, it would appear that the information contained on the offending page(s) is also encouraging Canadian citizens to buy certain products, and not to buy others. Given the recent rulings establishing that neither is more legal than the other, it seems to me that this is unfair economic interference with those parties who are involved in selling foreign DTH systems in Canada, and I would kindly ask that you remove any references that would favour any particular business, enterprise or sector of the industry.

I trust you find that this request is a reasonable one, and I shall expect compliance shortly, so that other action need not be taken.

Regards.

I can hardly wait for the reply.

Hehe.. Great stuff..

After all the injustice its time for them to react.. they had no buisness putting up that junk in the first place..

With these decisions they would be wize to take it down.. they have some pending lawsuits against them for their actions and behaviour..

The longer they keep it up the more foolish they look.. as they don't look foolish enough already..

Royal Farcers cut your strings and do the right thing.

I hope someone has copied and saved their web site in case it disappears.. which I doubt.

Hi Eddie,

I guess our minds sometimes think alike.

I called Industry Canada and spoke to Jo Anne there and made the exact same request. She promised someone would get back to me Monday.

Then I called Constable Louis Noreau and left him a long message about how they have mislead the public long enough with their erroneous interpretation of the law and their advertising for BEV and Star Choice on a publicly funded site. I left my Name and phone number in both cases and asked them to call back on Monday.

I think I will top that off with an E-mail over the weekend so that I am on record as having advised them of their improper stance. Once advised we will see just how negligent they can be :)

Gee I think I will “PIRATE” your letter and rewrite it just a bit as its a great entry point on the exact same subject . I hope you wont mind the plagerism. May I also suggest that about 10,000 other Canadians take the time to do the EXACT SAME THING!!
