Well given the recent decisions, I decided the RCMP ought to really change the content of their webpage.
So, today I emailed them:
Gentlemen:
On your webpage you have a 'consumer warning' posted, url:
http://www.rcmp-grc.gc.ca/html/satellite-e.htm
Within that 'warning' are contained assertions of certain activities alleged to be illegal.
There are now 5 Jurisdictions in Canada where the Radiocommunications Act has been interpreted by Superior or lower Courts contrary to that interpretation which you are putting forth on your web page.
One of those Superior Courts was recently upheld by the British Columbia Court of Appeal, the decision can be found at http://www.courts.gov.bc.ca/jdb-txt/ca/00/04/c00-0493.htm
Given the irrepairable harm that is being done to those who are involved in selling foreign DTH systems in Canada by your incorrect assertion of the RadioCommunications Act, I kindly request that you either:
1) completely remove the offending page(s)
or;
2) update the information contained on the offending page(s) to reflect the proper interpretations that have been applied in British Columbia, Saskatchewan, Nova Scota, Manitoba and Ontario.
or;
3) prevent persons who are using ISP services in British Columbia, Saskatchewan, Nova Scotia, Manitoba and Ontario from accessing the offending page(s).
Further, it would appear that the information contained on the offending page(s) is also encouraging Canadian citizens to buy certain products, and not to buy others. Given the recent rulings establishing that neither is more legal than the other, it seems to me that this is unfair economic interference with those parties who are involved in selling foreign DTH systems in Canada, and I would kindly ask that you remove any references that would favour any particular business, enterprise or sector of the industry.
I trust you find that this request is a reasonable one, and I shall expect compliance shortly, so that other action need not be taken.
