WoW,

I just got the word earlier today that Bell ExpressVu and their “ladies washroom tinkler“ McPuke LOST the Federal court case in Edmonton yesterday. What a BLACK DAY for THEM. Heh heh heh~~

The Judge Mr. Justice Clark REFUSED the injunction that Bell ExpressVu had asked against the Americans.

The Injunction was dismissed. I expect to receive a copy of the ruling over the weekend and I will scan and post it. My knowledge is scant right now other than that McPUKE LOST AGAIN!!!

Just to ADD a little flavor the Charges against Campenella in Hamilton were ALSO stayed because it took too long to come to trial. Another WIN for our side.

I really believe that the landfall is turning into a clean sweep of runings in our favor across the board.

As to the injunctions that McPuke was able to get early on, I think those days have passed and judges seem very reluctant to grant ANY injunction now, let alone those HORRIBLY unfair Anton Piller rulings.

McPulke has GOT to WIN the title of being the LOOSINGEST LAWYER in Canada right now. What an Honour eh!!

Time for Tedmonds to get back in the fray!!

Loses against Canucks.. and now the Yanks..

What a LOSER.. :)

And he represents NDS who we are know works very closely with one of those Yanks..

Do you think he will post this on his web site.. he is only a lawyer not a webhoster..

But he sure is getting HOSED.. :)

What a suprise he hasn't called Mr Peck's office yet..is it true that his Bell calling card got cancelled.. ya that must be why.. but he could have called collect..

You know McPuke.. reverse the charges.

What is the status of your case now? I thought the last I read they were waiting until after the Can-Am. Are you currently in session?

Hi Captbly,

My case was delayed and will be ruled on by the judge on November 27th. This was very positive as it is a preliminary hearing and the decision was postponed by the judge himself and not the Crown who usually try for delays.

The judge said that since we argued the law so extensively he wants to RE-READ the law and all the decisions. This is very promising as the easiest thing for any judge is just to send you on to trial saying to himself “if they are innocent that will be revealed at trial.” The PROBLEM is that, while true, it does not take into account the $200,000.00 or more a trial will cost, nor the tremendous delay this would cause to me and my wife. It will already be 2 years and one month when the ruling comes.

This judge is seriously thinking of TOSSING the case and wants the additional guidance of the BC ruling as well. Well, he will have MORE than that because 3 cases in Quebec will be heard in September (the 18th) and October and as I sat through all 3 cases and was heavily involved in preparing all the paperwork for TWO of them,(criminal lawyers don’t like paperwork or writing) THEY WILL ALL BE ACQUITTALS. And one of them WITHOUT a lawyer but FOUGHT as well as any lawyer by a very bright and capable defendant in Drummondville Quebec. This guy was GREAT!! I think he has at least the BEST case of all and we will LOVE the special ruling he may get. (Won‘t say what surprise yet, but I will report it when it happens. I will travel there for this FOR SURE.) So my judge will have the benefit of 3 more Quebec cases which are almost determinative of the issue as I am IN QUEBEC. Besides he has already seen all the evidence and that went VERY, VERY well. I believe he is offended by what has happened.

This route makes things VERY positive for me and almost CERTAIN.

Certainty is worth the additional 2 1/2 month wait as opposed to 1 year to be acquitted at a trial. The result, as I have always stated, is certain TO BE an Acquittal and total vindication for me and my wife and all my employees and customers. At LONG LAST!!
