Another MAJOR WIN..this sets the stage for more WINS to come in Quebec :)

Quebec has now joined the other provinces

We knew it would.. there is a very tight Quebec group that has done everything possible to see that it would happen..

I don't have the decision yet.. the Judge basically said that the defendent Jacques from Drummonville was committing no offence in Canada..

Jacques Defended himself against the EVIL forces of the Government..

TTRK had a MAJOR CONTRIBUTION in this case and I THANK HIM for this ever SO much !!

He is in Drummonville and both Radio and TV are there..Stories to come from the press..word has it that TTRK was wearing his PIRATE Tee-shirt in the courtroom :)

The Decision will be posting on Legal-rights as soon as possible..has to be translated into English..

The Judge did not give a ruling on the Charter as we had hoped.. but for very good reasons..the Judge said it was NOT necessary as the Jacques was NOT doing anything ILLEGAL in Canadian Law.. Thats a Big statement in its self..

TTRK will give a FULL report when he gets back tonight..

Even though as you all know I live in the NWT.. my case was transfered to Quebec..

What does this do for my case in Quebec :)

I have a Sept 26th court date and might get my ruling then..

How are you doing Madame Crown.. do you feel like a DORK.. maybe it hasn't sunk in yet.. but make no mistake you are ALL DORKS :)

perfect, that's just what I was waiting for...

in my case they also sent in an undercover to make a purchase of a card & system...

only thing is he didn't realize he was on candid camera :)

got the whole transaction, audio and video....

turns out this winner was a serious undercover drug agent at the time, later working in the manitoba witness protection program...I would sure hate to be one of the poort souls relying on this guy to keep them safe, he was so lax he made the purchase in his PERSONAL vehicle, of which we had the license recorded by the time he left the store...not too brilliant, most of these guys have unlisted phone numbers and lots of enemies....

now this is all going to be GREAT material (everyone loves live video) for the new http://www.rcmp-blunders.com which I have been just waiting for the right time to get put on-line....

Jacques and TTRK on prime time TV Tonight!,
I just saw both of them coming out of the court room with a big SMILE on their faces... As the French news reader (from TVA) showed and explained that it is not illegal for us Canadians to use/watch/decode/enjoy us programming from DirecTV... They showed Jacques inserting an H card in a receiver and explaining to the journalist what this was about...!!!

[To The Real King!!]

Hi Everyone,

Well I finally made it home driven by my good wifie dear (madam To The REAL King!!) who was kind enough to join me knowing the input into this case and just how important it was to me. I don’t drink liquor at all and suffer terrible pain when I do due to an arterial disease called Polymyalgia Rheumatica but tonight I am a little pissed on fine CHAMPAGNE and be DAMMED with the drinking and the pain. The EXTREME HAPPINESS overcomes all of that :)

The good FRENCH stuff which is wholly appropriate today going well with the defendant Mr. Jacques D’argy who did an INCREDIBLE job against THREE (yes count em, THREE) government lawyers against him. This is ONE HELL of a ballsy, intelligent guy who it turns out CERTAINLY DID NOT have a fool for a client :)

I have to say that this is ONE MAJOR ruling, the judge making it crystal clear that it concerns fixed access cards (black as the Ace of Spades) and that it is simply NOT against the law to view encrypted signals emanating from abroad that are NOT the property of a “lawful distributor “ in Canada. Funny but that was always clear to me (and most of us) and I truly feel we are VINDICATED today!!!

Guys I will have MUCH more to say tomorrow and I have NOT told you of the MANY incredible features of this WONDERFUL ruling yet but I didn’t sleep last night at all. I was more nervous than when I had my first daughter 38 years ago:)

I am so tired right now and so “SUFFICIENTLY SEFUNSIFIED" (and slightly inebriated with fine FRENCH champagne) that I am going to bed to sleep like a baby. This was my best day in MANY YEARS!!!

I do want everyone to know here and now however, that this is a CLASSIC example of WHY I live in Quebec and WHY cooperation between myself, Mr. Ian Angus and a really good guy like Jacques D’argy, a really brilliant guy, is so satisfying. Its a wonderful cooperative mix of two cultures, two languages and resulting in the CORRECT ruling. All the court appearances with the exception of American witnesses were held in FRENCH. All the written pleas were done in English. The judge, the Honourable Madam Justice Danielle Côté accepted this arrangement WILLINGLY and even EAGERLY and even made some comments in English in her ruling. The BEST possible combination of two cultures getting along perfectly. It was really great to be a part of this landmark ruling that pitted 2 small defendants themselves and without lawyers against our “BIG BAD” Canadian Government and THREE Crown lawyers. IMAGINE!!. And Jacques pointed to them in final arguments and said “ Look over there your Honour. The appearance of THREE BIG GOVERNMENT LAWYERS against us is JUST the TIP of the ICEBERG. It‘s TRULY INDECENT your honour!!!“

And it was!!!

I will post the ruling in French and also TRANSLATED into English on http://www.legal-rights.org tomorrow but it wont be early due to both my condition and that its 10 full pages long. I will also post here the rest of the details which were truly great. This ruling finding NO LAW has been broken (the first BLACK to CLEARLY say so) is absolutely as strong as ANY other ruling made so far in Canada, perhaps stronger. Its REALLY great as you will see with the posting.

Yes we did the TV thing and a video will be posted ASAP on legal-rights ASAP and YES I did wear my Pirates Den T-Shirt to court as I have done throughout my hearing and in GS2 and Al’s court too. Hell Call me a pirate and I feel I am entitled. And it did NOT change the outcome, did it.

I hope everyone can share our ELATION tonight but now we have both Quebec and Ontario which covers more that 60% of Canada’s population making it a TRULY NATIONAL thing what with B.C, Saskatchewan, Manitoba and Nova Scotia also in place. Three MORE Quebec ruling will be coming our way (and they are WINS on the facts apart from the jurisprudence) with TWO MORE (GS2’s next week:) ) of them probably within less than a month.

Fellow Canadians, WE HAVE ALL BEEN VINDICATED:D:D:D
