Hi Satellite Dealers,
Please note the incorrectness of this letter by the RCMP which seems designed to INTIMIDATE Canadian dealers but does NOT state the law at all. In fact a ruling made by the Honourable Mr. Justice Brenner of the Supreme Court of British Columbia says the EXACT OPPOSITE of what the RCMP try to state. The RCMP seem to think that the commercial licensing of Bell ExpressVu and Star Choice somehow CHANGES the meaning of the RC Act which was passed in 1991. Laws DO NOT change by the forming of commercial interests even MONOPLY ones. This is an OUTRAGEOUS proposition that everytimne a commercial corporate entity is formed in Canada, that could change the meaning of a law. INANE. And now the ruling of Mr. Justice Brenner DEBUNKS the ruling of Mr. Justice Gibson in the Federal Court of Canada and shows it to be incorrect and against parliaments intent. I wonder if they will change this outrageously innacurate letter and deliver a new one to satellite dealers stating that the most current ruling says that this conduct is LEGAL. I expect Commissioner Philip Murray may have a duty to deliver this NEW letter now that he is hand delivering letters via the RCMP, failure of which he may be subject to lawsuits by the industry under the CLASS ACTION LAWS for intimidating people "out of business" and not advising them when a similar ruling finds the conduct LEGAL!!

printed out and DEMAND to know when they will be delivering the letter that states the conduct is legal. Take a SPARE PRINTOUT of the ruuling and take the name of the RCMP officer you give it to. Call all your satellite friends and have them do this too. You have been TRAMPLED on long enough and it is time to FIGHT BACK while the rulings are in your favor. Do not delay and do this RIGHT AWAY!!!
Do it MONDAY morning and send me the name of the RCMP officer who gets the Brenner ruling from you. I will compile a list on the legal-rights site so that a class action suit can be filed on the basis of their having clearly beemn advised. I will also send a copy to commissioner Murray and I will ask Mr. Ian Angus to send him one too. Lets get bloody moving on this guys. Show us that YOU CARE!!!

In Canada, the reception of a programming signal originating from a distributor who is not authorized for such distribution in Canada constitutes an offence under the Radiocommunication Act. - Take notice also that on November 20, 1997, the Federal Court - Appeal Division - ruled that Section 9(1)(c) of the Radiocommunication Act is an absolute prohibition against the decoding of encrypted subscription program signals unless they originate from a lawful distributor in Canada and that distributor authorizes their decoding. - Section 9(1)(c) of the Act states: "No person shall decode an encrypted subscription programming signal or encrypted network feed otherwise than under and in accordance with an authorization from the lawful distributor of the signal or feed." - Further take notice that Section 10(1)(b) of the Act makes it an offence to, without lawful excuse, manufacture, import, distribute, offer for sale, operate, possess, etc., equipment, devices or components that are designed for the purpose of decoding or receiving encrypted broadcast signals in contravention of Section 9 of the Act. - Section 10(1)(b) of the Act states: "Every person who without lawful excuse, manufactures, imports, distributes, leases, offers for sale, sells, installs, modifies, operates or possesses any equipment or device, or any component thereof, under circumstances that give rise to a reasonable inference that the equipment, device or component has been used, or is or was intended to be used, for the purpose of contravening Section 9, is guilty of an offence punishable on summary conviction and is liable, in the case of an individual, to a fine not exceeding $5,000.00 or to imprisonment for a term not exceeding one year, or to both, or, in the case of a corporation, to a fine not exceeding $25,000.00" - Although any such device or equipment brought into Canada may have had duty and taxes paid, the above provisions of the Radiocommunication Act remain in effect. The possession, use, sale, etc., of any such equipment is therefore illegal. The customs issue concerning the importing of US digital satellite systems is under consideration by responsible government departments. - Further take notice that today, you are being notified of the law in Canada and the consequences that may result from non-compliance with the law.
