Don't mind me, I'm going to vent a little bit. Today my significant other just recieved his summons to appear for discovery(or something like that)
Let me give you some background, last summer he did a friend a favor. Our friends Bel-Aire just came out 3 days before, and he wanted to drink so my other half ended up driving the car for him that night.
To make a long story short he had to bridge the solenoid because it wouldn't start, and as that happened it jumped out of gear and ended up hitting someone. O.K. He has consequently been served with a lawsuit claiming the person who was hit will never be able to work again....ect. No problem, my other half is being sued for negligent driving, driving under the influence of alcohol, drugs or fatigue, failing to stop his vehicle and the list goes on. The only problem......HE WASN'T DRIVING! The owner of the vehicle was in the car as this was going on, and happened to be in the front seat. I still don't understand how you can be sued for "driving" when you are outside the car and even get hit by it yourself???
The guy who got hit didn't even want to go to the hospital that night, we had to force him to go! He scraped his knee up pretty bad, but other than that was released that night.
Now don't get me wrong, you get hit by a car and you do deserve $, but he's suing for loss of wages for the rest of his LIFE! He was supposed to start a new job in the fall, but couldn't due to his "brain waves getting messed up by getting hit by the car."(Direct Quote) I believe if you ae hurt that badly you shouldn't be out tubing, diving off 6ft diving boards, and dirt biking within 7 days of the accident(I personally witnessed all of that) It's sad to see people taking advantage of the system this way. It's also maddening, because guess who's insurance rates go up because of people like that....OURS!
To bad for this guy though , ICBC (our insurance carrier) has said they are going to fight this guy to the bitter end and they aren't going to give him a dime. Thank God, the only time they have done anything I agree with.
