Notice to DSS importers to Canada

NOTICE TO IMPORTERS
In keeping with the Canada Customs and Revenue Agency's (CCRA) principle
of transparency and responsible enforcement, the following pertains to the
legality of importing satellite dishes and other satellite equipment
capable of decoding encrypted TV satellite signals emanating from an
unlicensed American service provider.
Please be advised that while the Canada Customs and Revenue Agency cannot,
at this time, detain such goods under the provisions of the Customs Act,
it is still illegal to import, possess, sell or distribute this type of
satellite equipment pursuant to the Radiocommunications Act. Before
importing such equipment or requesting release of these goods if already
imported, we strongly urge you to contact Wayne Janzen of Industry Canada
at (780) 532-3533 or Sergeant G.M. Archibald of the RCMP at (613) 990-6246
to discuss the provisions of the Radiocommunications Act dealing with such
matter.
Should you decide not to request release of these goods, you have the
choice of abandoning or re-exporting them.
You should also be aware that the CCRA and the RCMP are exploring options
to control the importation of satellite equipment at the border.

Maybe someone should call Sgt. Archibald and tell him that he better do some research on why a product he calls illegal is declared legal to import from Canada Customs and also the courts.
Notices like this is really an outrage after everything that has happened and really goes to show that the RCMP and the crown have little intention to stop until they start being held accountable for un-neccessary prosecution

I READ SOMEWHERE THAT THE RCMP AND PROBABLY some other's go to el segundo. and guees who pay's
is that true?
well i guess a legal provider might also want to see this legal alternative shut down,so they can get more customer's.
i see future consultant's,job's etc,from 2 possible source's.

somebody need's to do some investigating here? and i'm not talking about investigating dss dealer's for trying to make a legal living.
seem's like a nice document to copy and add some commentary then send to the justice's ,just in case there not informed.
maybe they just might start a little investigation as to why and what the motivation'$ are of the people involved.
i mean they must not be getting a piece of the action the way there ruling.

W/the recent rulings I should move to Canada. Setup shop & challange SHMUCKS like this SGT. in court.
I guess the motto of this particular RCMP is $$$ talks & B*llS*it walks. Somebody should check his bank acct & check if HE'S watchin' Dave TV.

Very old intimination document that says that Industry Canada can go piss up a rope.. :) they don't dare hand out that piece of crap out anymore ;)

I have a copy of that very same letter given to a friend of mine sitting right here beside me. Had it for several months now, even e-mailed it to TTRK to see what he thought, he never responded :( (He's a busy guy)
Interesting part (at least from the way I read it), Is the statement that IT IS ILLEGAL TO IMPORT, POSSESS, SELL, OR DISTRIBUTE etc, etc.
Now if I come across the border with a bag of mary jane, thats illegal, and they will sieze it and I will be arrested.
However if I bring across these so called illegal devices (sattelite equipment), they can, at this time do nothing??!?!?!?!?

That is an old notice. It is not even on Customs letter head and further it does not even a file number.
All government publications (memos, letters, etc.) have file numbers so that they can filed under the Government Classification System so they can be easily retrieved for Freedom of Information Request purposes.
When did you get this notice and where?

I just got that document. It was sent to me by a friend (in the business) who swears that he just got a copy at the border. Yes, I know it is about 2 years old, but apparantly they are still handing it out.

Yes, I had also heard from a couple people that a couple ontario border locations were distributing those also

Hi Guys,
What IDIOTS the RCMP and Industry Canada are. The RCMP even had to take down their wbe page because it was ruled legal by the Ontario Court Of Appeals and now they have Appealed 3 rulings in Quebec (including mine) that were already appealed to the Superior Court. They now will get a Appeals Court of Quebec ruling which is likely to match up with all the other courts in Canada.
The best part of that is that Mckenzie will have to do a voodoo dance in the Supreme Court with Canada's 3 most populist provinces having rulings in the AppealsCourt of those provinces. I dont think ANY case EVER got there with that kind of a losing record :)
Even the Superior Court became aware that there was some type of unholey alliance going on here and severely scolded the crown for taking the last of these appeals. But the Crown (the Justice Department) are the same dunderheads as customs the RCMP and Industry Canada.
I don't think I have ever seen a case where there is such a strong agenda by Government that these people actually defy what the courts have said with htis issue. This takes some big time payoff and even the oppositions parties who should be having a ball with this in parliament are somehow disinterested or paid off to ignore it.Of coarse they have enough problems with their own stupidity, never mind the liberals stupidity in this issue. Pretty incredible.

I brought a brand new RCA across the border yesterday, paid the gst and pst, and continued back into Canada with no hassles of any kind. They saw the receipt and I also told them what it was.

Only a few border crossings still hand out the KAKA.. maybe some agents work for ExpressPuke also..
Its just a stupid bully paper that says they can't stop you from bringing in the goods but must warned you about violating the radio communication act.. everyone who crosses these border points should carry copies of the court decisions and ask them to read it.. then ask them if they dishonor the Judges and ignore the Law.. especially in Ontario with the Ontario Court of appeals Decision where the hassles are.. there isn't a higher court in Ontario so that's the law of that province and most others with maybe Alberta the exception that it is LEGAL

The eventual Canadian Supreme Court hearing will be a definitive day of reckoning against the arrogance of questionable business interests. We in the U.S. will hear a loud howl from the North, look up, and ask, "What's that noise?"

Personally, I think that if they can ignore over 20 decisions from different levels of courts and provinces, then why would they treat a supreme court decision any differently?
However, maybe once they start losing with costs and have a couple lawsuits going against them they will get the message.

I recieved a copy of that letter back in early Febuary. I almost hit the floor laughing when I read it. It was given to me at the Queenston bridge crossing at Niagra Falls. I was going to say something but decided to bite my lip to avoid any problems from the border guards. I think they do work for ExpressPuke :)

For the life of me, I can't understand how indifferent this government and expressvu seem to be towards the law. They shouldn't be able to ignore or manipulate the law in any way , shape or form and not have to make retribution for their ways.

Could type acceptance be at the heart of this farcey letter?
Its the only thing they can really make a claim too.
Like the FCC, IC has rules about equipment being sold when no type acceptance has been granted. Companies (Dealers, resellers, Importers..) can inport non-type accepted equipment as long as its not sold within their borders. I got this hassle when I worked for a radio communications outfit in Calgary.
Who know with guys..
Rise.. I think once were done with the Canadian S. Court I dont think they can make much of a claim to anything DTV related. Once ruled on its kinda hard to change.. I hope anyways :) Or there will be lawsuits after lawsuits.. until someone runs outta money or people get fired.
