The other one from the lawfirm..

No funds..

Cerified Check was sent out today Fedex by us to the lawfirm for ten big ones..

Seems to be lack of communication..?

Well Everyone,

I guess this was all settled in the Nick of time and funds from GS2 (Mr. Berlin on behalf of Legal-Rights I am told) and Eddie arrived at Mr. Richard Peck (the BC Lawyer) office in time.

The CanAm case will be one of the most important cases for us in Canada because it will be so far along the way when the BC Appeals court hears it at the end of May. It is also a very strong and well explained ruling by Mr. Justice Donald Brenner.

If it goes our way and the ruling is UPHELD then the next step is the final one to the Supreme Court of Canada. Mr. Peck has some expertise at fighting there too.

So on behalf of the Satellite Industry and of YOU ALL, Many thanks to Eddie and to Legal-Rights and Mr. Berlin & GS2. I am sure this will become more clear over time as I am a little confused right now as I was not consulted at all on the legal-rights money being paid out. I will report back when I know more about it.

Around a month ago it was discussed that the funds were going towards Can-Am..

In fact it was posted right here..

65% of the funds sent to Mr Berlin were contributed by two people.. one being myself and the other being someone you know quite well...

A good portion of the funds was used towards Tedmonds as we all agreed at the time.

Sorry if there was some confusion as I thought you knew from quite awhile ago and thought it was a good idea..

Everything was done in good faith with good intentions.. and we will make sure you are consulted on any future situations that may arise.

Actually I do agree that its a good idea. We MUST win the CanAm ruling as its the most important general benefit case right now in the entire country.

I was just pointing out that I was not consulted in any way by any one which was quite surprising. I was not called, I didnÕt see the thread (it must STILL be here as I think threads are archived), I didnÕt get any email and as you are well aware I was NOT in favor of the lawyers, who made no effort to collect the funds having any decision on how to dispense them. In fact I am not sure they have done anything at all.

I donÕt think that point was missed when you told me that you had heard that a lawyer was going to support a female defendant in Ontario whoÕs case is NOT special at this point with THESE funds. We BOTH were not in agreement with that.

I donÕt think its the lawyers job to decide but rather that of several people who made big donations, worked hard to raise money and agreed to organize the effort. I certainly qualify on every aspect there so why was I not consulted. Am I perhaps missing a message here?

DonÕt miss the point. I agree with the CanAm case, it will certainly affect other cases and it may be the shortest route to a solution for the whole industry. I just think these issues should not be decided by one or 2 people acting alone and IÕm not counting on the lawyers here. I havenÕt been out of town or away yet I heard nothing. You KNOW our mutual feeling of one of the main ones in this and the job he has done. We needed a good case like Mr. Peck has where something WILL be done that has a meaning to EVERYBODY.

GS2 Is there any money left and if so WHO is accountable for it. Is it Elliot and is he the other part of the us you mention that sent the check you reported on above. Cerified Check was sent out today Fedex by us to the lawfirm for ten big ones. Who is the current us?

Will you (or Elliot) soon be posting an accountability showing donators where and how the money was spent. That sounds like a reasonable idea except to leave out the names on anonymous contributors who wish to remain unknown. I am just trying to understand what things were accomplished with the donated money and what will become of the rest before those decisions are made.

By the way there is no suggestion of bad faith or bad intentions at all, just a lack of communication as you mentioned above. This, in fact, was probably the first action taken that was not at all discussed with me, unusual indeed considering the scope of my input on both fundraising and the legal-rights.org site. Perhaps you could have someone call me to explain whats hapened. I know you have been rather busy lately :)

Unfortunately as you know we had a lack of communication for awhile.

I believe it was during this time that myself and Mr D rushed to make this very important decision.

The ten big ones came from Berlin after he was yelled at for not doing what he was to suppose to do in the first place.

I have had no contact with him only D.

I spoke to D today as I do regularly and I think perhaps you should contact him.. he is not happy.. I am not happy.. and you are not happy.. over the same thing..

Then we can make a plan to address that situation..

Atleast the lawyers for Can-Am are now comfortable.. and a BIG thanks goes to Eddie for that also..

Hi SirJohnA,

The GS2 judge has already stated that he will wait for the CanAm case in BC for Guidance on this case. He will receive written pleas by the defence on the section 2B of the charter issue for August 15th and they return to court on I believe Sept 6th. At that time he will likely give the crown a month or so to reply, will have the CanAm ruling and so a decision should come in November or so, in my estimation. In my opinion if the Canam ruling is maintained its 99% a win for GS2 and if its lost (very doubtful) he still has a better than 50% chance with the fact pattern in this case.

There are VERY problematic issues that were raised for a Judge in this case and a conviction would have far reaching implications that will be hard to explain. Like CBC has been breaking the law in a SERIOUS WAY (filming and rebroadcasting) for many years from the DTV signal. How does the Government do what Canadians are NOT allowed to do (the receiving part) and more important HOW does an ILLEGAL signal (the rebroadcasting part) get converted to a legal one (broadcast on CBC by the CBC’s illegal act). Remember that Canadian signals from the CBC are LEGAL in Canada. Can an illegal act whitewash a signal and make it legal if you are Canadian? If so, if YOU tape a broadcast in Canada, does that whitewash it and make it legal like the CBC’s actions? Can an ILLEGAL act actually make something LEGAL again? That seems to go AGAINST the concept of “Law and Order”. Is our Government Corporations EXEMP from “Law and Order “in Canada?

How would you like to have to answer that question and what would the answer be? I think its quite reasonable for a citizen to do WHAT the Government has been doing for years or at lease do the receiving part. Or should they SHUT the CBC down like they have done to my business. What is justice for a small Canadian Busnessman and a large Government corporation? Or are they ABOVE the law?

GS2 may see it differently but this is my view.

There may also be a plea by GS2’s lawyers for an “abuse of process” under section 7 of the charter but its unclear if that will be in writing or even be made if GS2 is acquitted. I’m really not sure on that point.
